Izlīgums kā viens no atbrīvošanas no kriminālatbildības veidiem

Abstract

Bakalaura darba mērķis - raksturot izlīgumu, kā vienu no atbrīvošanas no kriminālatbildības veidiem, parādīt nepilnības, kas joprojām pastāv šī institūta normatīvajā regulējumā un sniegt priekšlikumus par izlīguma tiesiskā pamata pilnveidošanas iespējām. Bakalaura darbā ir 3 nodaļas. 1. nodaļā autore apskata atbrīvošanas no kriminālatbildības institūtu, sniedz tā vispārīgu raksturojumu, izdala divus atbrīvošanas no kriminālatbildības veidus un veic katra no tiem analīzi. 2. nodaļā autore pievēršas izlīguma kā viena no atbrīvošanas no kriminālatbildības veidiem regulējumam krimināltiesībās, apskata izlīgumu atjaunojošā taisnīguma tiesību sistēmas kontekstā, sniedz izlīguma regulējuma Krimināllikumā analīzi, salīdzina aktuālo normatīvo regulējumu ar to, kas pastāvēja pirms 2012. gada 13. decembra grozījumiem Krimināllikumā, analizē izlīguma formas, satura un realizācijas īpatnības, uzsver izlīguma priekšrocības un trūkumus. 3. nodaļa ir veltīta salīdzinošajai analīzei, pievēršoties ASV, Vācijas un kaimiņvalstu - Igaunijas un Lietuvas izlīguma institūta regulējuma analīzei. Balstoties uz veikto pētījumu, autore atklāj tās nepilnības, kas joprojām pastāv šī institūta normatīvajā regulējumā un sniedz priekšlikumus par to pilnveidošanas iespējām. The aim of this bachelor work is to describe settlement, as one of the ways person can be released from criminal liability, to show imperfections that are still obvious in legislation of this institute, and to provide proposals, showing possibilities in improvement of judicial base of this institute. Bachelor work consists of 3 chapters. In first chapter the author describes institute of release from criminal liability, provides overall description of it, points out two types of release from criminal liability and provides analysis of each type. In second chapter, the author focuses on regulation of settlement, as one of the ways person can be released from criminal liability in criminal law, examines settlement from the perspective of restorative justice, provides analysis of settlement regulation in Penal code, compares actual regulation with regulation that was in force before amendments of Penal code done on 13th of December 2012, provides analysis of the settlement form, content and realization procedure requirements, stresses the advantages and disadvantages of the settlement. Third chapter is dedicated to comparative analysis, focusing on regulation of the settlement in USA, Germany and neighbour countries – Estonia and Lithuania. Based on the performed research, the author reveals imperfections that still can be found in legislation of this institute and provides proposals, showing possibilities to improve judicial base of this institute.
