Krimināllikumā ir veltīta atsevišķa nodaļa, kura regulē krimināltiesību institūtu – apstākļus, kas izslēdz kriminālatbildību. Šie apstākļi ir norādīti Krimināllikuma 3. nodaļā. Ņemot vērā, ka sabiedrībai ir jāspēj par sevi pastāvēt, tai jāspēj aizsargāt sevi un arī citus. Tas ir viens no iemesliem, kādēļ krimināltiesībās šī joma ir pietiekoši aktuāla.
Apstākļi, kas izslēdz kriminālatbildību, kuri ir iekļauti Krimināllikuma 28. pantā, kopskaitā ir pieci. Tie ir: 1) nepieciešamā aizstāvēšanās, 2) aizturēšana, nodarot personai kaitējumu, 3) galējā nepieciešamība, 4) attaisnojams profesionālais risks, 5) noziedzīgas pavēles vai noziedzīga rīkojuma izpildīšana. Šajā bakalaura darbā sīkāk ir analizēts viens no kriminālatbildību izslēdzošajiem apstākļiem – nepieciešamā aizstāvēšanās.
Bakalaura darbam ir četras nodaļas.
Pirmajā nodaļā ir sniegts ieskats par apstākļu, kas izslēdz kriminālatbildību raksturojumu, tajā skaitā jēdzienisko izpratni un būtību, kā arī šo apstākļu kopējās pazīmes.
Otra nodaļa ir veltīta nepieciešamās aizstāvēšanās jēdzienam un būtībai, kā arī nepieciešamās aizstāvēšanās tiesīguma nosacījumiem.
Trešajā nodaļā ir aplūkota tiesu prakse saistībā ar nepieciešamo aizstāvēšanos, kopsakarībā ar Krimināllikuma 121. pantu, kas ir slepkavība, pārkāpjot nepieciešamās aizstāvēšanās robežas.
Ceturtajā nodaļā ir sniegts ieskats ārvalstu krimināllikumu analīzē saistībā ar nepieciešamo aizstāvēšanos.

The Criminal Act includes a dedicated chapter which regulates the institute of criminal law – the circumstances which exclude criminal liability. These circumstances are specified in Chapter 3 of the Criminal Act. Considering the fact that the society must be able to stand up for itself, it must be able to protect itself and also others. This is one of the reasons why this area is a pressing matter in criminal law.
In Article 28 of the Criminal Act, there is a total of five conditions which exclude criminal liability. They are: 1) justifiable defence, 2) causing harm to an individual during detention, 3) state of emergency, 4) justifiable professional risk, 5) illicit orders or obeying illicit instructions. This Bachelor Degree Paper includes an in-depth description of one of the circumstances which excludes criminal liability, i.e., justifiable defence.
The Bachelor Degree Paper consists of four sections.
The first section provides a brief description of the circumstances which exclude criminal liability, including the concept and nature, as well as the common properties of these circumstances.
The second section is dedicated to the concept and nature of justifiable defence as well as the conditions for lawfulness of justifiable defence.
The third section explores the judicial practices in regard to justifiable defence, in connection with Article 121 of the Criminal Act, which is homicide due to exceeding the limits established for justifiable defence.
The fourth section provides an insight into the analysis of foreign criminal acts in regard to justifiable defence.
