Ekonomiskās situācijas uzlabošanai un saimnieciskās vides sakārtošanai jebkurā valstī viens no ietekmīgākajiem līdzekļiem ir maksātnespējas tiesību sistēmas uzlabošana. Katrs jaunākais normatīvais akts nenoliedzami pilnveido iepriekšējo regulējumu, it sevišķi tas sakāms par maksātnespējas procesa efektivitātes principa attīstību, kas pakārtota procesa mērķim – palielināt komerctiesiskās apgrozības ātrumu. Līdz ar to ir svarīgi noskaidrot iespējamos faktorus, kas var kavēt sekmīgu procesa norisi.
Pētījuma atvieglošanai maksātnespējas process tika nosacīti sadalīts atsevišķos posmos, kuru ietvaros identificēti problēmjautājumi, kas būtiski var ietekmēt kopējo maksātnespējas procesa norises ilgumu.
Rezultāti liecina, ka likumā noteiktais maksātnespējas procesa ilgums ir par trešdaļu īsāks nekā statistiskais vidējais laika periods.

The improvement of insolvency legal system is one of the most influential means to improve the economic situation and the economic environment in any country. Each new normative act undeniably improves the previous legislation; in particular it can be said about the development of effectiveness principle of the insolvency proceedings, which are dependent on the aim of the proceedings - to increase the circulation speed of commercial rights. Therefore, it is important to clarify the possible factors that may impede the smooth conduct of the proceedings.
In order to facilitate the study the insolvency proceedings were conditionally divided into distinct phases within which the issues were identified, which can significantly affect the overall duration of the insolvency proceedings.
The results show that the statutory duration of insolvency proceedings is a third less than the statistical average time period.
