Darba tēma - „Piespiedu līdzekļu, kas saistīti ar brīvības atņemšanu, piemērošanas problemātika”.
Personu tiesību un brīvību ierobežošana ir pieļaujama, lai nodrošinātu iespēju vispusīgi un taisnīgi izskatīt kriminālprocesu pēc būtības un noskaidrot patiesību. Kriminālprocesa ietvaros speciālu tiesību ierobežošanu piemēro, lai novērstu kriminālprocesa norises traucēšanu, personas izvairīšanos no izmeklēšanas un tiesas.
Darba mērķis – izpētīt piespiedu līdzekļu, kas saistīti ar brīvības atņemšanu, piemērošanas problemātiku praksē.
Lai sasniegtu nosprausto darba mērķi, autors izvirzīja sekojošus uzdevumus – apskatīt piespiedu līdzekļu jēdzienu un izpratni; izpētīt ar brīvības atņemšanu saistīto piespiedu līdzekļu piemērošanu, grozīšanu, atcelšanu un pārsūdzēšanu; izpētīt ar brīvības atņemšanu saistīto piespiedu līdzekļu piemērošanas īpatnības nepilngadīgām personām un apskatīt cilvēktiesību un piespiedu līdzekļu mijiedarbību kriminālprocesa ietvaros.
Izvirzītā mērķa sasniegšanai darbs veidots no četrām nodaļām.
Pirmajā nodaļā apskatīts piespiedu līdzekļu jēdziens un tā izpratne.
Otrā nodaļa veltīta ar brīvības atņemšanu saistīto piespiedu līdzekļu - aizturēšana, apcietinājums, mājas arests un ievietošana ārstniecības iestādē ekspertīzes izdarīšanai, piemērošanas, grozīšanas, atcelšanas un pārsūdzēšanas kārtības izpētei.
Darba trešajā nodaļā pētītas ar brīvības atņemšanu saistīto piespiedu līdzekļu: apcietinājums un nepilngadīgā ievietošana sociālās korekcijas izglītības iestādē, piemērošanas īpatnības nepilngadīgām personām.
Savukārt, darba ceturtā nodaļā skatīts jautājums par cilvēktiesību un piespiedu līdzekļu mijiedarbību kriminālprocesa ietvaros.
Darba nobeigumā autors izvirzīja darba rakstīšanas gaitā aktualizējušos problēmjautājumus (secinājumus), kā arī piedāvāja savus priekšlikumus to risināšanai / novēršanai.
Darbs sastāv no 71.lpp., tas ir papildināts ar 3 pielikumiem. The theme of the paper – “Application Problems of the Compulsory Measures Related to Deprivation of Liberty”.
The restriction of the rights and freedoms is permissible to provide an opportunity to comprehensively and fairly deal with criminal procedures on the merits and clarify the truth. Within the framework of the criminal procedures special rights restriction is applied in order to prevent interference of the procedure and the person avoiding from the investigation and trial.
The aim of the Paper – to explore the application problems of compulsory measures related to the deprivation of liberty in practice.
To achieve the aim, the Author put forward the following tasks – to look at the concept of compulsory measures and comprehension; to explore the application, modification, revocation and appeal of the compulsory measures related to the deprivation of liberty; to explore the peculiarities of application of the compulsory measures related to deprivation of liberty to minors and look at interaction between human rights and the compulsory measures within the framework of criminal procedures.
To achieve the aim the Paper consists of four chapters.
The first chapter describes the concept and comprehension of the compulsory measures.
The second chapter is devoted to the research of the application, modification, revocation and appeal procedure of the compulsory measures related to the deprivation of liberty – apprehension, detention, house arrest and placement in a medical institution for the performance of an expert-examination.
The third chapter explores the application features of compulsory measures related to the deprivation of liberty to minors: arrest or placement in a social correction educational institution.
The fourth chapter overviews the interaction of human rights and compulsory measures within the framework of criminal procedure.
In the summary the author raised highlighted issues (findings) in the course of writing the work and offered the proposals for solving/prevention.
The Paper consists of 71 pages and 3 appendices.
