Maģistra darba autore analizē kaitējuma jēdzienu un atlīdzināšanas principus, cēloņsakarību kā kaitējuma atlīdzināšanas priekšnoteikumu, tādu specifisku kaitējumu veidu atlīdzināšanas īpatnības, kā mirušas personas radinieku tiesības prasīt morālā kaitējuma atlīdzināšanu, vecāku un bērnu tiesības prasīt kaitējuma atlīdzināšanu, kas radies “negribētās dzimšanas” un “negribētās dzīvības” dēļ, kā arī nemantiska kaitējuma apmēra noteikšanas problemātiku.
Darbā tiek atspoguļoti dažādu autoru viedokļi, kā arī darba autore pauž savu viedokli.
Pētījuma rezultātā maģistra darba autore nonāca pie secinājuma, ka pastāv vairākas īpatnības un problēmas saistībā ar kaitējuma kompensācijas apmēra noteikšanu un ar atsevišķu kaitējuma veidu atlīdzināšanu. Tāpēc darba autore piedāvā veikt korekcijas un papildinājumus Latvijas tiesību normatīvajos aktos, kā arī nonāk pie citiem būtiskiem secinājumiem. The author of the master work examines the definition of tort and compensation principles, ausal relationship as a precondition for tort compensation, peculiarities of compensation for particular types of tort, like rights of relatives of the deceased to claim compensation for moral tort, rights of parents and children to claim tort compensation resulting from "wrongful birth" and "wrongful life", as well as the issue of determination of compensation scope for nonmaterial tort.
The work reflects points of view of various authors, including the point of view of the author of the master work herself.
As a result of the research performed, the author of the master work concludes that there are various peculiarities and problems concerning determination of compensation scope for tort and compensation for particular types of tort. Therefore the author of the work suggests to specify and supplement the normative acts of Latvia and has come to other substantial conclusions.
