Amatierzvejas regulējuma galvenās tiesiskās problēmas Latvijā

Abstract

Maģistra darba nosaukums ir „Amatierzvejas regulējuma galvenās tiesiskās problēmas Latvijā”. Pirmajā nodaļā autors apskata amatierzvejas jēdzienu un vispārēju raksturojumu, kā arī uzsver nepieciešamība nošķirt amatierzveju no rūpnieciskās zvejas. Otrajā nodaļā autors pēta amatierzvejas galvenos priekšnoteikumus un tās ierobežojumus. Apakšnodaļās tiek pētītas problēmas, kas attiecas uz makšķerēšanas tiesību iegūšanu un izmantošanu, atļautajiem un aizliegtajiem makšķerēšanas rīkiem. Tiek apskatītas problēmas, kas saistītas ar atļauto loma lielumu, minimālo pieļaujamo zivju garuma noteikšanu un makšķerēšanas aizliegumiem. Trešā nodaļa ir veltīta makšķerēšanu regulējošo normatīvo aktu prasību ievērošanas kontrolei un problēmām, kas ar to saistās. Nobeigumā autors apskata zivju resursiem nodarītā kaitējuma atlīdzības īpatnības, uzmanību pievēršot atlīdzības taksēm piedzenamās summas aprēķināšanai un vides sakopšanas darbiem.

The title of the master’s work is “Main legal problems of amateur fishing regulation in Latvia”. The author analyses in the first chapter of the master’s work the concept of amateur fishing and its general description. Special attention is paid to the necessity to separate amateur fishing from industrial fishing. The second chapter is dedicated to main preconditions and restrictions of amateur fishing. In subchapters are analysed problems related to the obtaining and the exercising of the angling rights and problems related to permitted and prohibited angling gears. Also problems are analysed which concern with permissible amount of catch, minimum permissible length of fish and angling prohibitions. The third chapter is dedicated to the control of compliance with the angling regulations. At the end of the master’s work the author analyses the compensation of the harm caused to fish resources and the restoration of the environment.
