Darbs ir pētījums par to, kāpēc Latvijā tiesu prakse lietās par tiesību uz darījuma pamata nostiprināšanu zemesgrāmatās ir ļoti pretrunīga, kas savukārt negatīvi ietekmē nekustamo īpašumu civiltiesisko apgrozību un tiesiskās paļāvības principu. Izpētes rezultātā, kā galvenie cēloņi un iemesli atšķirīgai tiesu praksei konstatēti- tiesību normās noteikto kompetences robežu nepilnīga izpratne dokumentu materiāltiesiskajā pārbaudē, numerus clausus principa daļēja neievērošana, kā arī nepilnīgs tiesiskais regulējums. Darbā izmantoti un analizēti gan Latvijas, gan ārvalstu tiesu prakses materiāli, normatīvie akti un atsevišķu autoru zinātniskās atziņas, kā arī piedāvāts iespējamais risinājums konstatēto problēmjautājumu novēršanā. This Paper is a research about contradictious jurisdiction in cases concerning corroboration of rights in Land Register on the base of transactions, thus affecting the real estate circulation by civil law and the principle of protection of legitimate expectations negatively. As a result of the research there were the main causes of differing jurisdictions determined – incomplete comprehension of borders of the competence stipulated in legal norms during the substantive inspection of documents, a partial non-observance of numerus clausus principle, as well as incomplete regulation which can be interpreted in different ways. There were jurisdiction materials, legal acts and scientific considerations of particular authors of both Latvia and other countries used and analyzed within this Paper. There was also a potential solution proposed in order to solve the detected issues.
