Kapsētu un apbedīšanas tiesiskais regulējums Latvijas Republikā

Abstract

Darbā „Kapsētu un Apbedīšanas tiesiskais regulējums Latvijas Republikā” autore ir pievērsusies līdz šim maz pētītiem, bet sabiedrībai aktuāliem jautajiem, kas saistīti ar tiesiskā regulējuma un prakses problēmām mirušo apbedīšanas jomā. Darbā ir analizēti un doti juridiski pamatojumi nepieciešamajām izmaiņām normatīvajos aktos. Autore, analizējot pašreizējo situāciju valstī, ir pētījusi un salīdzinājusi vēsturisko normatīvo aktu regulējumu, ka arī apkopojusi dažādos viedokļus un vairāku biedrību un Rīgas pilsētas pašvaldību izstrādātos jaunos tiesību aktus projektus. Īpaša uzmanība darbā veltīta pašvaldībām, kurām viena no autonomām kompetencēm ir tieši kapsētu uzturēšana un apbedīšana. Autore analizējusi vairāk kā trīsdesmit pašvaldību izdotos kapsētu uzturēšanas noteikumus, izstrādājot pastāvošos kapsētu izveides un apsaimniekošanas modeļus Latvijā. Apbedīšanas pakalpojumu sniedzēju kā specifiska komercdarbības veida licenzēšanas un kontroles nepieciešamība. Ar apbedīšanu saistīto darbinieku apmācības nepieciešamība. Bez iepriekš minētajiem jautājumiem darbā tiek arī aplūkoti mirušā apbedīšanas, pārvadāšanas tiesiskie aspekti, tai skaitā problēmas, kas rodas pēc mirušā apbedīšanas (pārapbedīšana regulējuma trūkums, nepilnīgie apbedīto reģistri, kontrole un atbildība), apbedīšanas uzņēmumu licenzēšanas un darbinieku apmācības nepieciešamība. Darbā galvenokārt izmantoti tiesību akti, to projekti, darba autores personīgā prakse, darbojoties LELB Rūjienas Svētā Bērtuļa draudzes padomē un sadarbojoties ar Valmieras rajona pašvaldībām un Rīgas pilsētas pašvaldību un citi materiāli.

In the paper „Legal Regulation on Cemeteries and Burial in the Republic of Latvia” the author turned to until now little studied but actual matters for the society related to legal regulation and practice problems in the sphere of perished persons’ burial. This paper gives analysis and legal basis for the amendments required to regulatory enactments. Analyzing the present-day situation in the state, the author studied an compared the historic regulation of regulatory enactments, as well as generalized different viewpoints and a number of societies as well as new draft bills developed by local authorities of Riga city. Special attention is paid in the paper to the local authorities, where one of their self-governing competence is directly maintenance of cemeteries and burial thereon. The author analyzed more than thirty cemetery maintenance regulations issued by local authorities developing the arrangement and management models of the cemeteries existing in Latvia. The necessity of licensing and control over funeral service providers as the specific sphere of commercial activities. In addition to the earlier specified issues legal aspects of burials and farewell ceremony of the deceased were viewed in the paper including the problems arisen after funerals of the deceased (the lack of rebury regulation, incomplete bury registers, supervision and liability), the necessity of licensing of burial service companies and personnel’ training. Enactments, draft documents thereof, personal practical experience of the paper author working at LELB Rūjienas Svētā Bērtuļa draudze council and collaborating with the Valmiera region local authorities and Riga local authorities, as well as other materials have been generally applied in the paper.
