| dc.description.abstract | Kad nomirst persona, Latvijas mantojuma tiesības pieprasa tiesību pārņēmēja darbību - gribas izteikumu, lai viņš varētu kļūt par mantinieku, un mirušā manta (saistības) pārietu uz viņu. Šī darbība ir mantojuma pieņemšana – tiesību institūts, ar kuru mantinieks izdara savu pirmo, bet galveno soli, lai iegūtu mantojumu, jo atpakaļceļa nav – mantojumu pieņemot, to atraidīt nevar.
Šajā pētījumā tiks apskatīts mantojuma pieņemšanas institūts, kā tas ir izveidojies un attīstījies. Latvijas mantojuma tiesībās ir elementi no dažādiem civillikumiem apvienoti. Problēmjautājumi, kas radušies, tika analizēti, un doti priekšlikumi to atrisināšanai, apskatot katru mantojuma pieņemšanas institūta elementu – pieņemšanas formu, pieņemšanas termiņu, faktisko valdījumu u.c., atsevišķi, paralēli ieskatoties romiešu tiesībās un citu valstu normatīvajos aktos. Ar šo darbu autors grib panākt diskusiju rašanos par mantojuma tiesību pilnveidošanas un modernizācijas nepieciešamību, tā saskaņošanu ar šodienas situāciju, kad mantojuma lietas tiek kārtotas pie zvērināta notāra nevis kā agrāk tiesā.
Pētījuma rezultātā autors secina, ka mantojuma pieņemšanas institūtu var saskaņot, attīstīt un modernizēt, nosakot konkrētu mantojuma pieņemšanas termiņa atskaites punktu, definējot mantojuma iegūšanu, uz līgumisko mantinieku attiecināt mantojuma pieņemšanas prezumpciju, ja viņam nav tiesības mantojumu atraidīt, kā arī piedāvā alternatīvu risinājumu, pieņemot prezumpciju, ka mantinieka klusēšana ir mantojuma pieņemšana, kā rezultātā atkristu vairākas ar mantojuma pieņemšanu šobrīd saistītas problēmas un pretrunas. | en_US |
| dc.description.abstract | When a person dies inheritance law of Latvia requires an action of the successor so that he could become a heir, and so that the property (obligations) could be transferred to him. This action is acceptance of inheritance – a legal institute, with whom the heir expresses his first but primary step to acquire the inheritance, because there is no turning back – by accepting the inheritance it cannot renounced.
In this research institute of acceptance of inheritance will be examined, how did it develop and evolve. Inheritance law of Latvia contains unified elements from different civil laws. Problems which arose were analyzed and suggestions for solution were given by examining every element of acceptance of inheritance - form of acceptance, term of acceptance, actual possession etc., individually and with cross examination of Roman law and other regulations from other countries. With this research the author wishes to establish a discussion about the necessity of improvement and modernization of inheritance law, it’s harmonization with the situation of today, when inheritance case is administered by a notary and not by court as before.
With this research the author concludes that institute of acceptance of inheritance can be harmonized, evolved and modernized by establishing a fixed accounting point for term of acceptance of inheritance, by a definition of acquirement of acceptance, by assigning a presumption of acceptance to the heir of contract if he doesn’t enjoy the right to waive it, and also offers an alternative solution as to adopt the presumption that the silence of the heir is acceptance of inheritance, with whom other problems relating to acceptance of inheritance would vanish. | en_US |
