Maģistra darba mērķis ir sniegt ieskatu tiesiskajā regulējumā, ja mantojuma masā ietilpst nekustamais īpašums.
Maģistra darbs sastāv no trīs nodaļām, secinājumiem, tiesu prakses, kā arī juridiskās literatūras avotiem. Pirmā nodaļa tiek veltīta legātam- vai nekustamais īpašums var tikt uzskatīts par legāta priekšmetu civillikuma izpratnē, kādi ir problēmjautājumi saņemot nekustamo īpašumu kā legātu un kā notiek legāta samazināšana, ja legāta priekšmets ir nekustamais īpašums. Otrajā nodaļā tiek izpētīti svarīgākie aspekti, ja laulātais manto nekustamo īpašumu. Noslēdzošajā trešajā nodaļā tiek apskatīts tāds ļoti būtisks jautājums mantojuma tiesībās kā mantojuma dalīšana, sīkāk apskatot tieši mantojuma masā ietilpstošā nekustamā īpašuma reālo sadali, kā arī iespējamos citus sadales veidus, ja reālā sadale kādu iemeslu dēļ nav iespējama.
Galvenie atzinumi Maģistra darbā ir, ka par legāta priekšmetu var būt nekustamais īpašums, ja zemesgrāmatā nav piemetinājuma par atsevišķo mantu, nekustamais īpašums uzskatāms par laulāto kopējo mantu, kā arī, ka Pirms tiesa veic nekustamā īpašuma reālo sadali, tai jāņem vērā īpašuma lietošanas tiesību aprobežojumi un būvju un ēku lietošanas tiesību aprobežojumi. The goal of the Magistracy’s Paper is providing insight in the legal regulation in case the mass of an inheritance contains an immovable property.
The Magistracy’s Paper consists of three chapters, conclusions, jurisprudence, as well as sources of legal literature. The first chapter deals with a legate – whether the immovable property may be considered to be a subject of the legate for the purpose of the Civil Law; what issues cause problems when the immovable property is received as the legate and how decreasing of the legate is carried out, in case the subject of the legate is the immovable property. The second chapter explores the most important aspects in case a spouse inherits an immovable property. The final – third chapter deals with a very essential issue of the hereditary right – division of the inheritance, paying more detailed attention to actual division of the immovable property which is the part of the mass of an inheritance, as well as other possible ways of division in case the actual division by some reason is not possible.
The main conclusions made in the Magistracy’s Paper is the fact that an immovable property may be the subject of the legate, if in the Land Book there is no remark about a separate property, the immovable property is regarded to be a common property of the spouses, as well as before the court carries out actual division of the immovable property, it should take into account the limitation of the right to use the property as well as the right to use the buildings and constructions.
