Mūsdienās, ekonomiskās krīzes ietekmē, ir būtiski paaugstinājies to parādnieku skaits, kas nespēj pildīt savas saistības, it sevišķi parādsaistības ar kredītiestādēm, kuras savukārt cieš no neatmaksātiem aizdevumiem. Kredītiestādes galvenokārt izsniedz kredītus nodrošinot prasību ar hipotekāro ķīlu, līdz ar to nespējot samaksāt parādu parādniekam un jārēķinās ar to, ka piedziņa visdrīzāk tiks veikta uz ķīlas tiesību objektu – nekustamo īpašumu. Maģistra darba „Piedziņas vēršana uz nekustamo īpašumu” pirmajā nodaļā, tiek apskatīta vispārējā tiesas un citu institūciju nolēmumu izpilde un piedziņas vēršana uz nekustamo īpašumu no vēsturiskā un mūsdienu skatu punkta, apskatot pastāvošās atšķirības un pievēršot uzmanību normu, kas regulē piedziņas procesu, vēsturiskajai attīstībai. Otrajā nodaļā, analizētas un salīdzināts piedziņas vēršanas uz nekustamo īpašumu nosacījumi un process Latvijas un Krievijas Federācijas likumdošanas kopskatā, apskatītot problēmas, ar ko sastopas tiesu izpildītāji, piedziņas gaitā uz tādiem nekustamiem īpašumiem, kuriem zemesgrāmatā ir reģistrēti apgrūtinājumi – prasības nodrošinājuma un ķīlas tiesību atzīmes veidā. Trešajā un ceturtajā nodaļā apskatīti nekustamā īpašuma realizācijas procesa, pārdošanas izsolē – sagatavošana, organizēšana, kā arī nekustamā īpašuma izsoles sekas, jo veiktie grozījumi LR Civilprocesa likumā, visbūtiskāk ir skāruši tie šo piedziņas procesa uz nekustamo īpašumu stadiju. Nowadays, under the influence of economical crisis, considerably increased the number of debtors, who cannot fulfill their liabilities, especially their debt commitments in relation to credit institutions, who in their turn suffer from the unpaid loans. Basically, credit institutions grant loans, guaranteeing their claims with the mortgage pledge, that is why, unable to pay the debt, debtors have to count on the fact that the recovery will be directed on the object of pledge – the immovable property.
By comparing historical and actual legal norms, in the first part of the diploma paper “Addressing of Collection to Real Estate”, there was studied judgment enforcement of courts and other institutions and addressing the collection to immovable property from both, historical and today’s point of view, revealing the existing distinctions and paying attention to historical development of legal norms which regulate the process of the collection. Considering that many years Latvia was politically bounded with Russia, which influenced the legal system of Latvia both, before the war and during USSR times, in the second part of the diploma paper there are analyzed conditions and the process of addressing the collection to real estate together in the legislation of Latvia and in Russian Federation. There were examined problems which are faced by bailiffs in the process of collection, related to such immovable property, on which in the Land Register are registered burdens - guarantee of claims and pledge notes. In the third and fourth part of the diploma paper there were explored the consequences of the immovable property sale, real estate auction and its preparation and organization, as the amendments of the Latvian Civil procedure law most of all concerned exactly these parts of the immovable property collection process.
