Maģistra darbā tiek pētīts tiesāšanās izdevumu regulējums civilprocesuālo principu aspektā. Darba mērķis ir rast atbildi uz jautājumu – vai pašreizējais tiesāšanās izdevumu institūta regulējums Civilprocesa likumā un ar to sistēmiski saistītajos likumdošanas aktos nodrošina tādu civilprocesuālo principu īstenošanu kā samērīgums, izlīguma veicināšana pušu starpā, īpaši akcentējot pušu vienlīdzības un līdztiesības un tiesas pieejamības aspektu. Detalizēti analizējot katru no tiesāšanās izdevumu veidiem kopsakarā ar piemēriem no tiesu prakses, darbā izvirzīti konkrēti problēmjautājumi. Kā viens no tiem nosaukts atšķirīgā tiesu prakse tiesāšanās izdevumu veidu izpratnē, to identificēšanā par tiesas izdevumiem vai ar lietas izskatīšanu saistītajiem izdevumiem, prasības summas noteikšanā, valsts nodevas aprēķināšanā un tiesas izdevumu sadalījumā pēc lietas izskatīšanas. This master’s degree work investugates the regulation of litigation expenses according to tehe aspect of principles of civil process. The aim of the research work is to find the answer to the questionwhether the present regulation of the institution of litigation expenses in tse law of civil process and in the legislationdeeds that are sistematically connectedwiht it, guaranteerealizingthe principles of civil process such as proportionality of concliation between sides, giving particular attention to the aspect of equality, equality of rights and court accessibility for sides. Analising in details every form of the examples from court practise concrete problematical questions are propounded in this research paper. Aso ne of the problems is named a quite different court practise in the form conception according to the litigation expenses identificating them as the court expenses or the case trial expenses, as will as fixing the claim sum, the calculation of the state duty awd the distribution of court expenses after the case trial.
