Tiesību normu piemērošanā izmantojamo metožu iedalījuma problēmas

Abstract

Maģistra darba temats „Tiesību normu piemērošanā izmantojamo metožu iedalījuma problēmas” veltīts vairākiem svarīgiem un savstarpēji saistītiem juridiskās metodes mācības aspektiem. Pirmkārt, tiesību doktrīnā un arī praksē nav vienota iedalījuma metodēm, kuras piemērotājs izmanto tiesību normu piemērošanas gaitā. Līdz ar to viens no autora maģistra darba mērķiem ir noteikt skaidru saturu tiesību normu piemērošanā izmantojamām metodēm un veidot to iedalījumu. Autors darbā aplūko metodes intra, secundum legem, praeter legem, extra legem un contra legem, par kuru saturu tiesību doktrīnā izteikti atšķirīgi viedokļi. Analizējot doktrīnu un metodei atbilstošo piemērotāju praksi, autors nošķir piemērošanas metodes un veido tām konkrētu saturu. Otrkārt, lai noteiktu saturu katrai no metodēm, autors analizē tiesību avotus, kas ir konkrētās metodes piemērošanas pamatā. Atsevišķiem tiesību avotu veidiem ir veltīti padziļināti pētījumi, bet visi normas piemērošanā izmantojamie avoti nav strukturēti vienotā sistēmā. Tāpēc autors formulē tiesību normas mērķa noskaidrošanas un normas meklēšanas sfēru teoriju. Teorijas pamatā ir iedalījums tiesību normas, likuma sistēmas, tiesību sistēmas un tiesiskās sistēmas sfērās. Tas ļauj strukturēt piemērošanas metodes, jo katrā sfērā esošo avotu izmantošanai atbilst konkrēta metode. Treškārt, īpašu uzmanību darbā autors pievērš likumpārsniedzošās tiesību tālākveidošanas vietai metožu iedalījumā, kas ir Latvijā retāk pētīts jautājums. Bez tam esošajos pētījumos par tās saturu ir izteikti pretēji viedokļi. Autors darba rezultātā secina, ka likumpārsniedzošā tiesību tālākveidošana apzīmējama ar metodi extra legem.

Topic of the master’s degree work «Problems related to classification the methods of application of legal norms» is dedicated to a several important and interrelated aspects of the theory of legal method. First of all, in the legal doctrine and also in practice there is no unified classification of the methods, which applicator uses in process of application of legal norms. That’s why one of the aims of author's master's work is to establish clear content of the methods, which is used in application of legal norms and to build the division of them. Author of the work inspects such methods as intra, secundum legem, praeter legem, extra legem and contra legem, content of which in legal doctrine is expressed in dissimilar opinions. Analyzing the doctrine and the corresponding method in the applied practice, the author separates the methods of applying and forms their specific content. Secondly, in order to determine the contents of each of the methods, author analyzes the sources of law, which is the base of applying of each specific method. There are researches, which are devoted to several sources of law, but all sources of application of legal norms are not structured in a single system. That's why author formulates the legal norms target – finding and norms search sphere theory. Theory is based on the classification of the legal norms, law system, legal system and judicial system spheres. It allows making the structure of the methods of application, because each sphere of the sources corresponds to a particular method. Thirdly, author pays special attention to the over the law existing further law – making method and its place in the methods classification, which is rarely studied issue in Latvian. Moreover, in the existing researches there are dissimilar opinions about the content of the mentioned method. As the result of the work, author concludes that the over the law existing further law – making method is identified as the method of extra legem.
