Mūsdienu tehnoloģijas un ekonomisko procesu attīstības ietekmē, cilvēki meklē arvien vieglākus un ātrākus veidus kā slēgt darījumus, dažreiz pat aizmirstot par formalitātēm. Tādēļ starptautiskajā šķīrējtiesas praksē bieži rodas gadījumi, kad šķīrējtiesai ir jāizvēlas, vai iesaistīt šķīrējtiesas procesā šķīrējtiesas līgumu neparakstījušu sabiedrību, kas pieder pie vienas sabiedrību grupas ar šķīrējtiesas līgumu parakstījušo pusi un kas ir piedalījusies tirdzniecības līguma noslēgšanā, izpildē vai izbeigšanā. Sākotnēji šāda rīcība var likties nepamatota, tā kā šķīrējtiesas process ir konsensuāls un prasa pušu piekrišanu. Taču šķīrējtiesu un nacionālo tiesu praksē ir izveidojusies doktrīna, saskaņā ar kuru sabiedrību grupas dalībnieki var tikt iesaistīti šķīrējtiesas procesā, izpildoties noteiktiem kritērijiem.
Ņemot vērā šādu situāciju nozīmību starptautiskajās komercattiecībās, šajā darbā autors ir pētījis sabiedrību grupas doktrīnas pamatus, piemērošanas kritērijus un praksi, lai izzinātu iespējas piemērot sabiedrību grupas doktrīnu gan šķīrējtiesu, gan nacionālo tiesu praksē. In effect of nowadays development of technology and economic procedures, people are looking for easier and faster ways to concealing the deals, sometimes forgetting about the formalities. Therefore in practice of international arbitration there are times when the tribunal has to decide whether to compel a member of group of companies to arbitration proceeding, considering it has not signed the arbitration agreement and though has participated in conclusion, performance or termination of a contract. At first it seems impossible as arbitration proceeding are purely of consensual nature and requires consent of all parties. Though in the practice of tribunals and national courts there is an established doctrine where under certain circumstances such companies can be compelled to arbitration.
Due to the importance of the situation in commercial relationship author has been studying the basics, criteria and practice of application of the group of companies doctrine, in order to find out the possibilities to apply group the doctrine in the practice of arbitration tribunals and national courts.
