LABTICĪGA IEGUVĒJA AIZSARDZĪBA. Ņemot vērā, ka LR Tieslietu ministrija 2010.gada februārī nodeva apstiprināšanai LR Ministru kabinetam Koncepcijas projektu par Civillikuma lietu tiesību daļas modernizāciju, nekustamā īpašuma labticīga ieguvēja aizsardzības jautājums ir kļuvis par vienu no aktuālākajiem civiltiesību jautājumiem. No tiesību zinātnieku secinājumiem un priekšlikumiem lielā mērā atkarīgs, kāds turpmāk Latvijas valstī būs nekustamā īpašuma labticīga ieguvēja aizsardzības regulējums.
Autore ir analizējusi nekustamā īpašuma labticīga ieguvēja aizsardzības regulējumu atbilstoši spēkā esošajiem normatīvajiem aktiem un sniegusi priekšlikumus spēkā esošajā regulējuma taisnīgākai piemērošanai. Lai secinājumi būtu pamatoti, autore ir pētījusi arī gadu desmitiem un simtiem senas doktrīnas un tiesu praksi, no kuras redzams, kā tika interpretētas un piemēroti tie normatīvie akti, uz kuru pamata savulaik tika izstrādāts CL regulējums nekustamā īpašuma labticīga ieguvēja aizsardzībai. Ņemot vērā, ka visnotaļ sarežģītas tiesiskās situācijas rodas gadījumos, kad jāizšķiras starp labticīgā ieguvēja aizsardzību un tāda zemesgrāmatā neierakstīta īpašnieka aizsardzību, kurš ieguvis īpašuma tiesības ieilguma ceļā, autore īpašu nozīmi ir piešķīrusi labticīgā ieilguma jautājuma pētīšanai. Rezultātā autore nonāk pie secinājuma, ka atbilstoši pašlaik spēkā esošajam normatīvajam regulējumam īpašuma tiesības ieilguma gadījumā rodas uz likuma pamata neatkarīgi no to ierakstīšanas zemesgrāmatās, bet šīs tiesības tiek zaudētas, ja trešā persona labticīgi ieguvusi nekustamo īpašumu no formālā zemesgrāmatās ierakstītā īpašnieka un ir ierakstījusi savas tiesības zemesgrāmatās.
Pievienojoties tiesību zinātniekiem, kas izteikuši priekšlikumu pārņemt Vācijas nekustamā īpašuma labticīgā ieguvēja aizsardzības regulējumu, autore izsaka priekšlikumu attiecīgo labticīgā ieguvēja aizsardzības regulējumu attiecināt tikai uz atlīdzības darījumiem un iekļaut noteikumus par zemesgrāmatā neierakstītā patiesā īpašnieka tiesībām gada laikā izpirkt lietu no labticīgās trešās personas par cenu, par kādu labticīgā trešā persona īpašumu iegādājusies. Tāpat autore iesaka atteikties no nekustamā īpašuma ieilguma līdzšinējā regulējuma, kas atbilst kustamo lietu ieilgumam un pārņemt Vācijas tiesībās regulēto „tabulāro ieilgumu” (Tabularersitzung – vāc.). Autore arī uzskata par vēlamu nekustamo īpašumu pircēju aizsardzības nolūkos izveidot noslēgto nekustamo īpašumu atsavināšanas līgumu reģistru, uzliekot zvērinātiem notāriem par pienākumu tajā ieskatīties pirms katra nostiprinājuma lūguma apstiprināšanas un informēt nostiprinājuma lūgumu parakstītājus par attiecībā uz konkrēto nekustamo īpašumu esošiem zemesgrāmatā vēl neierakstītiem pirkuma līgumiem. PROTECTION OF A FAIR PURCHASER. With respect to the fact that on February 2010 the Ministry of Justice of the Republic of Latvia delivered for confirmation in the Cabinet of the Republic of Latvia the Draft concept on modernization of Property Law part of the Civil Law, the issue on protection of a fair purchaser of the real estate has become one of the most topical issues of the Civil Law. To a great extent the further regulation of protection of a fair purchaser of the real estate in Latvia will depend on the conclusions and proposals of the law scientists.
The author has analysed the regulation of protection of a fair purchaser of the real estate according to the valid normative acts and provided proposal for more just application of the valid regulation. In order to make the conclusions supported, the author has studied tens and hundreds year’s old doctrines and court practice, which show how were interpreted and applied those normative acts, upon which the Civil Law regulation for protection of a fair of the real estate was developed. Considering the fact that quite complicated legal situations emerge in those cases when the decision has to be made between the protection of a fair purchaser and protection of the owner, which is not recorded in the Land register, and who has acquired the property rights in the way of time limitation, the author specially emphasizes research of the fair time limitation issue. In the result the author has concluded that according to the currently valid normative regulation the property rights in the case of time limitation occur under the law irrespective of recording thereof in the land register, but those rights are forfeit once the third party fairly purchases the real estate from the formal owner, recorded in the land register, and has recorded his/her rights in the land register.
Adhering to those law scientists, who have proposed to adopt the German regulation of protection of a fair purchaser of the real estate, the author suggests to refer the respective regulation of protection of a fair purchaser of the real estate only towards reward transaction and to include the provisions regarding the non-recorded in land register real purchaser`s rights to repurchase the property from the fair third party within a year at the price at which the fair third party had purchased the property. The author also suggests waiving the former real estate time limitation regulation, which complies with the time limitation of chattels, by adopting the “tabular limitation” regulated by the German law (Tabularersitzung – in German). The author also thinks that it is desirable for the purpose of protection of the real estate purchasers to create the register of concluded real estate alienation contracts, by obligating the sworn notaries to look into it before each certification of consolidation request and to inform the signers of the consolidation requests about existence of the purchase contracts to the specific real estate, which are not yet recorded in the land register.
