In this master`s theses authoress analyzes till now not so often examined issue related to the applicable law for non-contractual obligations arising from tort under the Rome II regulation.
The same as the Brussels I regulation, which regulates issues of jurisdiction, also Rome II regulation is one of the necessary measures to reach the attainment of greater convergence in the civil law between the Member States as a matter of priority to the proper functioning of the internal market. However, considering the fact that the Rome II regulation is a new legal instrument, choice of law rules for non-contractual obligations may cause confusion for the Member States.
Therefore, aim of master`s theses is to conclude whether the new regulation is necessary and suitable to increase efficiency and legal certainty between the Member States with regard to privat international law governing non-contractual obligations, to understand the esence of regulation and general conditions, and to find out which law will be applicable in the cases of non-contractual obligations arising from tort.
The previous practice of Member States shows that the approach that the preference for the country where the event giving rise to the damage occurred as the general rule, which is based on the argument that this place can normally be rather easily determined and assigned to a certain law, in times of economic globalization is no longer convincing. In contrast, the Rome II regulation establishes an objective connection between the loss and applicable law, which continue to reflect the modern concept of civil liability approach, which is no longer based on the orientation to the punishment of offender, but the compensation provision, which apparently spreads from the scheme based on non-strict liability.
In the theses authoress concludes that if the same substantive national law applies, irrespective of the Member State in which the action is brought, it ensures the predictably of the outcome of litigation, certainty as to the applicable law and also the free movement of judgments. Thus, with the Rome II regulation is achieved greater legal certainty in Community.
All in all the basic approach of the Roma II regulation can be welcomed as a further step on the path towards harmonization of European private international law, but given the fact that the Rome II regulation is relatively new Community legal instrument, its real impact can be judged only over time, according to court practice reflection and interpretation. In dieser Magister Arbeit Autorin behandelt bislang wenig analysierten, aber in die letzte Zeit aktuelle Frage Ņber anzuwendende Recht fŅr auβervertragliche Schuldverhältnisse, die ergebt sich aus der unerlaubten Handlungen, entsprechend nach der Rom II-Verordnung.
Ebenso wie die BrŅssel I-Verordnung, auch Rom II-Verordnung ist eine von der notwendigen Maßnahmen in Harmonisierung von zivilrechtliche Angelegenheiten zwischen den Mitgliedstaaten, was sichert ein besseren geeigneten Binnenmarktes der Gemeinschaft. Jedoch unter BerŅcksichtigung der Tatsache, dass die Rom II-Verordnung ist ein brandneues Quelle des Rechts, Mitgliedstaaten kann Problemen haben um zu feststellen, welchen anzuwendende Recht mussen sie wahlen.
Deshalb Ziel des Master Arbeits ist zu verstehen die Notwendigkeit von Harmonisierung zu anzuwendende Recht mit Beistand des Rom II-Verordnung, die Art der Regulierung und allgemeine Bedingungen, so zu versuchen herauszufinden, welche anzuwendende Recht mussen die Mitgliedstaaten wahlen in entsprechende auβervertragliche Schuldverhältnissfall, was erhellt sich von unerlaubten Handlung.
Bisher gelten in den Mitgliedstaaten unterschiedliche Vorschriften darŅber, welche Rechtsordnung bei Sachverhalten mit AuslandsberŅhrung zur Anwendung kommt. Daher kann es zu unterschiedlichen Ergebnissen kommen, je nachdem in welchem Staat ein Rechtsstreit entschieden wird. Aber dieses Zugang ist nicht erschĻpfend, es ist widersprŅchlich und veraltet. Als allgemeine Regel sieht die Rom II-Verordnung nun vor, dass auf eine unerlaubte Handlung das Recht des Staates angewandt wird, in dem der Schaden eingetreten ist. Dieses Zugang darstellt dem modernen Begriff der zivilrechtlichen Haftung Ansatz, der nicht mehr beruht auf der Grundlage der Orientierung auf die Bestrafung der Täter, aber der Ausgleich Versorgung, was folgt von der verschuldensunabhängigen Haftung.
In Rahmen von diesen Master Arbeit Autorin kommt zu der Einsicht, wenn die gleichen materiellen nationales Recht gilt, unabhängig von dem Mitgliedstaat, in dem die Klage erhoben wird, sorgt das Vorhersage der Ausgang von Rechtsstreitigkeiten, Bestimmtheit das anwendbare Recht und auch die FreizŅgigkeit der Urteilen. So erreicht auch die Rom II-Verordnung ein grĻßere Rechtssicherheit in der EG.
Alles in allem kann man den grundlegenden Ansatz der Roma-II-Verordnung als ein weiterer Schritt auf dem Weg zur Harmonisierung des europäischen internationalen Privatrechts zu begrŅßen, doch angesichts der Tatsache, dass die Rom II-Verordnung ist ein relativ neues Rechtsinstrument der Gemeinschaft, ihre tatsächlichen Auswirkungen werden beurteilt nur Ņber die Zeit nach der gerichtlichen Praxis Reflexion und Interpretation.
