Vienlīdzības principa transformācija Latvijā laika posmā no 1918. gada līdz mūsdienām

Abstract

Maģistra darba tēma - vienlīdzības principa transformācija Latvijā no 1918. gada līdz mūsdienām. Vienlīdzības princips ir viens no galvenajiem tiesību principiem mūsdienās. Vienlīdzības princips ir nostiprināts gan nozīmīgākajās cilvēktiesību aizsardzības konvencijās, gan valstu konstitūcijās. Autors par darba mērķi izvirza noskaidrot, kā vienlīdzības princips ir attīstījies Latvijā laika posmā no 1918. gada līdz mūsdienām. Lai sasniegtu darba mērķi, autors izvirza uzdevumus noskaidrot vienlīdzības principa vēsturisko attīstību, analizēt, kā vienlīdzības princips tika realizēts Latvijas Republikā starpkaru periodā, izvērtēt, vai vienlīdzības princips pastāvēja Vācijas okupācijas laikā, analizēt vienlīdzības principu un tā attīstību Latvijas PSR un izpētīt, kā vienlīdzības princips tiek realizēts, un kādas problēmas ir novērojamas attiecībā uz vienlīdzības principa ievērošanu mūsdienās. Darba beigās autors nonāk pie secinājumiem, ka jāturpina vienlīdzības principa nostiprināšana Latvijas Republikas likumdošanā, Saeimai pārņemot regulās noteiktos vienlīdzības principa regulējumus, kritiski jāizvērtē, kādi noteikumi tieši Latvijas Republikā ir nepieciešami attiecībā uz vienlīdzības principa aizsardzību. Aurtors arī secina, ka ir nepieciešams veikt vairākus grozījumus Latvijas Republikas likumdošanā, lai nostiprinātu vienlīdzības principa aizsardzību sabiedrībā.

The Master’s thesis is dedicated to the transformation of the principle of equality in Latvia from 1918 up to nowadays. Today, the principle of equality is one of the key principles of human rights. The equality principle has been stipulated in the major conventions for the protection of human rights as well as in the national constitutions. In the paper, the author’s objective is to examine how the principle of equality has developed in Latvia during the time period from 1918 up to nowadays. To reach the objective, the author sets the following tasks: to clarify the historical development of the principle of equality, analyse how the equality principle was implemented in the Republic of Latvia during the interwar period, assess whether the principle of equality existed during the German occupation, analyse the equality principle and its evolution in the Latvian SSR, and examine how the principle of equality is implemented nowadays and what challenges are observed with respect to complying with this principle today. In the final part of the paper, the author concludes that the implementation of the equality principle in the legislation of the Republic of Latvia should continue, with the Saeima taking over the regulation of the principle of equality as stipulated by Regulations, critically assessing which regulations in particular are necessary in the Republic of Latvia with respect to the protection of the equality principle. The author also expresses his opinion that several amendments are required to be made to the Republic of Latvia legislation in order to enforce the protection of the equality principle in the public.
