Humanitārā intervence un pienākums aizsargāt mūsdienu starptautiskajās publiskajās tiesībās

Abstract

Darba mērķis ir noskaidrot, vai starptautiskajās tiesībās pastāv humanitārās intervences tiesība. Pirmā daļa izstrādāta kā ievads darbā apspriežamajās tēmās. Otrā autore meklē atbildi uz jautājumu, vai humanitārā intervence ir atļauta starptautiskajās tiesībās. Sākumā tiek izvērtēta iespēja, vai paši ANO Statūti neparedz humanitārās nepieciešamības izņēmumu, līdz ar to atļaujot spēka lietošanu humanitāros nolūkos. Pēc tam tiek apskatītas citas iespējas kā humanitārās intervences tiesība varētu pastāvēt starptautiskajās tiesībās, īpašu uzmanību pievēršot jautājumam, vai šāda tiesība varētu būt izveidojusies caur valstu praksi. Pamatojoties uz teorētiskās analīzes rezultātiem, nākamā nodaļa tiek veltīta valstu prakses izpētei. Beigās tiek veikti secinājumi un pēdējā nodaļā piedāvātas iespējas humanitārās intervences jautājuma atrisināšanā.

The aim of this study is to find out, whether a right of humanitarian intervention exists in international law. The first is an introduction to the issues addressed. The second part is dedicated to finding the answer to the question posed in the beginning of the study. The first chapter explores the possibility that humanitarian intervention might be allowed as an exception to the prohibition of the use of force in Article 2(4) of the UN Charter. Afterwards, the author explores whether there are other possibilities for the inclusion of a right of humanitarian intervention in international law, focusing on the question whether such a right might have developed through state practice. At the end of the study conclusions are made, and in the last chapter proposals on how to solve the problem of humanitarian intervention are given.
