Politisko amatpersonu politiskā atbildība

Abstract

Politiskās atbildības jēdzienu mēdz izmantot gan politiķi, gan masu mediji, gan dažādi pētnieki, gan arī "vienkāršie" cilvēki. Papildus tam, politiskās atbildības jēdziens ir izmantots normatīvajos aktos un tiesu institūciju spriedumos, tomēr tā visaptverošs skaidrojums nav formulēts, tāpēc ir izveidojusies politiskās atbildības dažādā interpretācija. Minētais rada problēmas situācijās, kad subjekti, kuriem jāuzņemas politiskā atbildība, nevēlas atzīt savu vainu, vai gadījumos, kad subjekti, kuriem ir tiesības pieprasīt politisko atbildību, izmanto savas tiesības bez taisnīga pamatojuma. Tas ir arī viens no galvenajiem "sliktas" pārvaldes iemesliem. Darba ietvaros autors analizē politisko amatpersonu politisko atbildību, jo attiecīgie subjekti publiskajā vidē un zinātniskajā teorijā visbiežāk tiek saistīti ar politiskās atbildības jēdzienu. Darba galvenais uzdevums ir izveidot visaptverošu politisko amatpersonu politiskās atbildības definējumu. Rezultātā autors definē pozitīvo politisko atbildību – politiskās amatpersonas pareiza rīcība, kas atbilst attiecīgās rīcības vērtētāju un iespējamo sankciju piemērotāju interesēm, un ir saistīta ar šīs amatpersonas pienākumu pildīšanu un tiesību realizāciju; un negatīvo politisko atbildību – nepareiza rīcība, kas neatbilst attiecīgās rīcības vērtētāju un iespējamo sankciju piemērotāju interesēm, un ir saistīta ar šīs amatpersonas pienākumu pildīšanu un tiesību realizāciju, un kuras veikšanas rezultātā pret politisko amatpersonu tiek piemērotas sankcijas.

Term political responsibility frequently is being used by politicians, mass media, political scientists, and common people, it is even used in legislation and judgments of the courts, however the most interesting thing is that there is no comprehensive definition of this term, and it is being used in different meanings. This creates problems, when subjects, who must take on the responsibility, do not want to admit their fault, or when subject who have the rights to demand the responsibilty, may use their rights without justified reason. It is also one of the main reasons for bad governing and abuse of power. In this work author anlyse political responsibility of subjects who are most frequently associated with this term, id est ruling politicians (politcal officials), with aim to formulate comprehensive definition of political responsibility, and concludes that there can be postive political responsibility – an action of political officials, which satisfies the political interests (related with the use / acquirement / distribution of power) of subjects, who are capable to enforce sanctions, and negative political responsibility, – an action of political officials, which does not satisfy the political interests (related with the use / acquirement / distribution of power) of subjects, who are capable to enforce sanctions, and the enforcement of sanctions by these subjects.
