In the present thesis on the topic “Legal Grounds of Living Space Lease” problematic issues of defining rent ahead of forthcoming changes in the housing law are observed. The author’s chosen topic concerns the issue that never loses its relevance, since it addresses the field of right to the availability of living space on the one hand, and right to the unhampered use of private property on the other hand. By observing the problematic aspects of applicable legal regulation and by evaluating opinions of owners and tenants representatives, in order to identify the most substantial aspects of the observed topic for the parties, the author attempts to find the appropriate ways for resolving these issues. Within this topic the author examines the experience of several European countries, indicating the models of defining rent, which would be the most relevant for Latvia as well. The author also examines judicial practice for defining the standpoint of courts in cases of relevant category and the most disputable aspects. As a result, the author offers her own alternative view on the future of legal regulation of rent.
