Administratīvi teritoriālās reformas ietekme uz bāriņtiesu darbības efektivitāti socioloģiskās sistēmteorijas diskursā

Abstract

Maģistra darba tēmu „Administratīvi teritoriālās reformas ietekme uz bāriņtiesu darbības efektivitāti socioloģiskās sistēmteorijas diskursā” autore ir izvēlējusies, jo administratīvi teritoriālā reforma, kas noslēdzās 2009.gadā, ir ieviesusi būtiskas korekcijas pašvaldību teritoriju kontūrās Latvijas kartē, vienlaikus atstājot lielu ietekmi arī uz pašvaldību sniegto pakalpojumu kvalitāti un pieejamību. Viena no valsts nozīmīgākajām funkcijām – aizsargāt nepilngadīgo un citu rīcībnespējīgo tiesības un tiesiskās intereses, ir nodota pašvaldību izveidoto bāriņtiesu kompetencē, līdz ar ko būtiski ir saprast, kādu ietekmi uz bāriņtiesu darbības efektivitāti reforma ir atstājusi. Līdz šim publiski pieejamie pētījumi ir ekonomiska rakstura, mazu uzmanību pievēršot reformas ietekmei uz sabiedrību un norisēm tajā. Uzskatot, ka tikai tādu varas realizētu darbību, kas ievēro sabiedrisko domu, rezultātā, ir iespējama sabiedrības aktīva un pozitīva līdzdalība valstij nozīmīgu jautājumu izpildīšanā un tiesiskuma veicināšanā, autore šī darba ietvaros ir analizējusi reformu un sabiedrības savstarpējo mijiedarbību, īpašu uzmanību pievēršot Niklasa Lūmana izstrādātajai sistēmas teorijai, vērtējusi administratīvi teritoriālās reformas un bāriņtiesas darbības mērķus un efektivitātes kritērijus, noslēgumā izdarot secinājumus par administratīvi teritoriālās reformas ietekmi uz bāriņtiesu darbības efektivitāti. Maģistra darba izstrādes rezultātā autore ir secinājusi, ka administratīvi teritoriālās reformas rezultātā bāriņtiesu darbības efektivitāte ir mazinājusies - bāriņtiesu locekļu un darbinieku profesionalitāte objektīvi vērtējot nav pieaugusi, iepriekš esošās sistēmas problēmas nav nedz novērstas, nedz mazinājušās, papildus kam ir apgrūtināta bāriņtiesas un sabiedrības ikdienas komunikācija, jo bāriņtiesa atrodas tālāk no savas darbības adresāta. Ar maģistra darbu autore vēlas atklāt diskusiju par bāriņtiesas institūta modernizācijas nepieciešamību, uzsākot bāriņtiesu funkciju lietderības izvērtējumu un optimizāciju, nolūkā nodrošināt bāriņtiesas darbības mērķa pilnīgu realizāciju, efektivitāti un pieejamību.

Theme of the Master’s paper "Impact of the administrative and territorial reform on efficiency of the Orphans Court activity in discourse of sociological system theory" the author has chosen because the administrative territorial reform which has been ended in 2009, has introduced a relevant adjustment to the contours of Latvian municipalities on the map, while leaving a great impact on the quality and availability of services provided by municipality. One of the state's most important functions to protect rights and legal interests of minors and other incapacitated has been transferred to the Orphans Courts established by local governments and in this connection it is important to understand what impact the reform has left on the efficiency of Orphans Courts. Till the present time available public researches were of economic nature, little attention was paid to the influence of reform on society and on the processes in it. Considering that only through the activities realized by the power structures taking into account any public opinion, it is possible an active and positive participation of the state in resolving the country-relevant issues in critical issues and promoting legitimacy, the author of this work examined the interaction of reforms and society, with particular attention to Nicklas Luman’s theory of a system. The author also has evaluated the administrative and territorial reform and efficiency criteria of the Orphans Courts activity, making conclusions in the end of work about the impact of administrative and territorial reforms on efficiency of the Orphans Courts activity. Developing the Master’s paper the author has concluded that as a result of the administrative and territorial reform of the Orphans Court is diminished efficiency of the Orphans Courts activity - professionalism of the Orphans Court members and staff objectively is not increased, problems of pre-existing system are neither eliminated nor diminished, in addition daily communication of the Orphans Court and society is embarrased because the Orphans Court is located farther from the recipient's of it’s activities. By the Master's paper the author would like to open a discussion on the need for modernization of the Institute of Orphans Courts, to begin evaluating whether the functions of Orphans Courts, to ensure the full realization of the objectives, effectiveness and accessibility of the Orphans Court.
