Suverenitātes koncepta transformācijas XX gadsimtā

Abstract

Maģistra darbs ir veltīts suverenitātes koncepta izmaiņām XX gadsimtā. Suverenitātes teorija ir neatņemama valsts un tiesību teorijas vēstures, un teorijas sastāvdaļa. Darba mērķis balstoties uz suverenitātes koncepta izpratnes izmaiņām XX gadsimtā, veikt sistemātisku suverenitātes koncepta analīzi. Par darba galveno uzdevumu kļuva galveno suverenitātes konceptu transformācijas iezīmju izziņa, sekojot hronoloģijai – līdz XX gadsimtam, XX gadsimta gaitā, kā arī XXI sākumā. XX gadsimts ieviesa daudzas izmaiņas klasiskajā, gadsimtu praksē balstītajā suverenitātes konceptā. Notikušās izmaiņas bija vērstas uz koncepta t.s. depolitizāciju, t.i. tās nepamatotas virsvadības uzturēšanas noliegšanas un disproporcijas starp lex ferenda un lex lata mazināšanu. Minētie procesi sekmēja suverenitātes sašaurināšanu, tādējādi liekot uzsvaru uz leģitimitāti, kā primāro valsts un tiesību esības kritēriju.

Master's thesis is devoted to transformations of the concept of sovereignty during the XX century. The theory of sovereignty is an integral part of the theory and history, both the state and law. The purpose of paper is systematic analysis of the concept of sovereignty, based on its understanding of the XX century. The main goal of this paper was to identify major trends in the transformation of sovereignty, following the chronology - up to XX century, during the XX, as well as at the beginning of the XXI century. XX century brought many changes to the classic and well-established for centuries the theory of sovereignty. The changes were aimed at the so-called depoliticization of the concept of artificial desires to maintain the rule of sovereignty, regardless of the content and are created by the imbalance between the lex ferenda and the lex lata. These processes have stimulated the processes of narrowing the concept of sovereignty to its physicall framework, thus emphasizing the legitimacy as the primary criterion for the existence of state and law.
