Šī darba galveinais mērķis ir ir pētīt un izzināt Augstākās tiesas Senāta departamentu priekšsēdētāju sēdes institūtu Latvijas tiesu sistēmā, tā pašreizējo formu un darbību, nodrošinot atbilstošu lietu pakļautības jautājuma izšķiršanu attiecīgās lietas juridiski pareizai un taisnīgai izspriešanai.Kā arī vienlaikus noskaidrot,kā dažādās valstīs tiek risināti lietu pakļautības strīdi starp dažādām tiesām, aplūkojot gan institūcijas, kas šādus strīdus ir tiesīgas risināt, gan arī procesuālas dabas jautājumus, kas saitīti ar strīdu risināšanas procesu.
Darbs galvenokārt ir balstīts uz regulējumu salīdzināšanu Latvijā, Francijā, Austrijā, Spānijā, Vācijā un Lietuvā.
Pirmajā darba nodaļā autore aplūko vispārēju lietu pakļautības un jurisdikcijas jēdzienu izprati, kā arī aplūko pakļautības strīdu izpratni un to rašanās priekšnoteikumus.Otrajā nodaļa autore aplūko dažādu lietu pkaļautības strīdu izšķiršanas institūciju veidus, pievēršoties gan strīdu risināšana iespējām tiesā, Konstitucionālājā tiesā, Augstākajā tiesai, kā arī tam speciali veidotā tiesu nstitūcijā. Šajā nodaļā īpaši tiek aplūkota arī Priekšsēdētāju sēdes tiesības izšķirt pakļautības strīdus un tās vieta valstsinstitūciju sistēmā.
Trešajā nodaļā autore aplūko dažādus procesualos noteikumus, kas saistīti ar pakļautības strīdu izšķiršanu, tai skaitā, pakļautības strīdu veidus, personas, kam paredzētas tiesības iniciēt pakļautība strīdus, strīdus srisināšanas institūcijas lēmuma saistošos spēu, kā arī citus procesuālās dabas jautājumus.
Darba ceturtajā nodaļā autore pievērsīsies dažiem Priekšsēdētāju sēdes līdzšinējo lēmumu problemātikas aplūkošanai.
Darba gaitā autore secina, ka Augtākās tiesas Senāta departamentu Priekšsēdētāju sēde ir atzīstama par tiesu konkrētās lietas ietvaros un tās lēmumi ir tiesām saistoši. Kā arī autore secina, ka līdzšinējā sēdes lēmumu prakse ir pretēja Latvijas normatīvajam regulējumam, kā arī rada nepareizu principa res judicata izpratni Latvijā. Darba gaitā autore izsaka priekšlikumus par citāda pakļautības strīdu risināšanas institūta nepieciešmības noteikšanu Latvijā. The main objective of this Paper is to elaborate how disputes over the jurisdiction may be resolved in different countries. In this Paper the author draws the attention to the system of conflict resolution and focuses to the institutions, which are authorized by law to decide the disputes over jurisdiction, and to the procedural provisions regarding to dispute resolution. The object of this Paper also is to draw the attention to the special Session of the Chief Justices of the Departments of the Supreme Court of the Republic of Latvia, what is authorized to hear disputes over the jurisdiction in Latvia. In the first part of the Paper, the author draws the attention to the general understanding of the jurisdiction and competence between different courts, as well as the understanding of disputes over the jurisdiction and the reasons why such disputes may arise. In the second part of the Paper, the author focuses to the different systems for the resolution of dispute over jurisdiction, which may depend on the judicial system of each country. In this part the author focuses to the dispute resolution in Constitutional courts, Supreme Courts and in special judicial authorities, which consist of judges from different courts. In the third part of the paper, the author focuses on the different procedural provisions regarding to resolution of jurisdiction disputes. In the fourth par of the paper, the author draws the attention to the problems in the case law of the Special session of the Chief Justices of the Departments of the Supreme Court.
The main conclusions found in Summary part of the Paper are followings: firstly, the Special session of the Chief Justices of the Departments of the Supreme Court shall be considered as a court within particular court case and therefore its decisions shall be considered with a binding effect to a judge who initiated the matter in this Special session. Secondly, a current case law of this Special session is contrary to the Latvian law in some cases, as well as is based on inappropriate understanding of the principle of res judicata. Thirdly, the author found necessary to amend the current form of dispute resolution over the jurisdiction in Latvia and also expresses her proposals.
