Šajā maģistra darbā ietvaros tiek apskatīts Krimināllikuma 121. pantā paredzētais noziedzīgais nodarījums – slepkavība, pārkāpjot nepieciešamās aizstāvēšanās robežas.
Darbs ir strukturēts trijās daļās.
Maģistra darba pirmajā daļā ir aplūkota apstākļu, kas izslēdz kriminālatbildību, institūta būtība un attīstība, veltot uzmanību tās nozīmei Latvijas tiesībās. Tālāk autore pievēršas nepieciešamās aizstāvēšanās jēdziena analīzei, nepieciešamās aizstāvēšanās robežu noteikšanai un citiem nepieciešamās aizstāvēšanās aktuālajiem jautājumiem, jo tas ir neatrauti saistīts ar maģistra darba tematu. Šīs nodaļas ietvaros autore arī veic vēsturisko pētījumu, lai noskaidrotu kā atbildība par slepkavību, pārkāpjot nepieciešamās aizstāvēšanās robežas, tika regulēta dažādos krimināltiesību avotos, kuri bija spēkā Latvijas teritorijā pēdējā gadsimta laikā.
Maģistra darba otras daļas sakumā tiek pievērsta uzmanība slepkavības jēdzienam un slepkavības pamatsastāva sastāvam, lai sagatavotu lasītāju pie KL 121. pantā paredzēta noziedzīga nodarījuma sastāva analīzei. Šajā nodaļā autore daudz atsaucas uz Latvijas tiesu praksi, izsaka savu viedokli par panta piemērošanas problēmām, veic salīdzinājumu ar citiem noziedzīgiem nodarījumiem.
Maģistra darba trešajā daļā autore aplūko, kā atbildība par slepkavību, pārkāpjot nepieciešamās aizstāvēšanās robežas, ir regulēta ārzemju krimināltiesību avotos.
Maģistra darba kopsavilkumā tiek izklāstīti darba gaitā izdarītie secinājumi, autores piedāvātie risinājumi attiecībā uz nepieciešamās aizstāvēšanās institūta uzlabošanu, izvirzīts viedoklis par iespējamo ārvalstu prakses pārņemšanu atsevišķos jautājumos un, līdz ar to, arī KL 121. panta grozījumu veikšanu. This Master paper is about Murder committed exceeding the limits of necessary self-defense, section 121 of the Criminal law of Latvia.
The work is structured in three parts.
The firs part of Master paper describes the grounds, nature and development of Institute of excluding criminal responsibility, paying attention to its importance in Latvian law. Next what the author focuses on is analysis of the concept of necessary self-defense and exceeding the limits of necessary self-defense analysis, because it is close connected with subject of Master paper. In this chapter the author also carried out historical research in order to clarify the responsibility for the Murder committed exceeding the limits of necessary self-defense, were regulated in different sources of criminal law in force Latvian territory over the last century.
In the beginning of the second part of Master paper, author describes the concept of murder and the murder of a frame-stock in order to prepare the reader to analysis of section 121 of the Criminal law of Latvia. In this chapter the author relies more on the Latvian court practice, expresses her views on the application of Article challenges, compare Murder committed exceeding the limits of necessary self-defense with other criminal offenses.
In the third part of Master paper the author looks at how responsibility for the Murder committed exceeding the limits of necessary self-defense is governed by foreign sources of criminal law.
Master's Thesis is working out in the findings, the author's proposed solutions for the improvement of necessary self-defense Institute, put forward views on the foreign practices in some matters and, therefore, the section 121 of the Criminal law of Latvia amendments.
