Atstāšana bez palīdzības ( Krimināllikuma 141. pants)

Abstract

Autores maģistra darba temats ir “Atstāšana bez palīdzības”. (Krimināllikuma 141. pants). Minētais Krimināllikuma pants vienmēr ir bijis aktuāls, arī šobrīd, jo nereti masu komunikācijas līdzekļos ir ziņas par to, ka noticis nelaimes gadījums, bet cilvēki tā vietā, lai sniegtu konkrētajā situācijā nepieciešamo palīdzību, vienaldzīgi noskatās vai paiet garām. Darba mērķis bija Krimināllikuma 141. panta analīze par to, kā minētais pants darbojas praksē, noskaidrot, ko nozīmē pantā ietvertie jēdzieni, kā arī analizēt problēmas, kas saskatāmas gan pašā panta būtībā, gan tā praktiskajā piemērošanas praksē. Darba ietvaros autore pētīja normatīvos aktus par atstāšanu bez palīdzības gan Latvijā, gan ārvalstīs, iepazina Krimināllikuma 141. pantā ietvertā kriminālpārkāpuma attīstības vēsturi Latvijas teritorijā, sākot no divdesmitā gadsimta trīsdesmitajiem gadiem, veica Krimināllikuma 141. pantā iekļauto noziedzīgo nodarījumu sastāvu analīzi, sasaistot to ar Latvijā pastāvošo tiesu praksi, kas atsevišķos gadījumos ir diskusijas vērta. Tāpat darba gaitā autore noskaidroja Krimināllikuma 141. pantā ietverto jēdzienu “nepieciešama” un “acīm redzami neatliekama” palīdzība skaidrojumu, vērtējot gan juridiskajā, gan medicīniskajā literatūrā paustos viedokļus. Īpašu uzmanību autore pievērsa nepamatoti atšķirīgajai tiesu praksei saistībā ar ceļu satiksmes negadījumiem, kad ir jāveido Krimināllikuma 260. panta attiecīgās daļas kopība ar Krimināllikuma 141. pantu. Darba rezultātā autore secināja, ka Krimināllikuma 141. pantā ir nepieciešami grozījumi, lai tiesību aizsardzības iestādēm būtu vieglāk šo pantu piemērot to praktiskajā darbā.

The title of this master’s thesis is ‘Abandonment without Assistance’ (Section 141 of the Criminal Law). Section 141 has always been and still is a subject of concern, because quite often the mass media report about cases of accidents that have occurred, when instead of giving help, people around have remained indifferent or just walked away. The purpose of this thesis was to study how Section 141 of the Criminal Law works in practice, to clarify the notions used in this section and to analyse the potential problems relating to the essence of the section and to the application thereof in practice. In order to carry out the thesis, the author studied both Latvian and foreign laws and regulations regarding the subject of abandonment without assistance, did research on the historical development of the said criminal violation in the territory of Latvia starting from the thirties of the XX century, analysed the constituent elements of the criminal offences mentioned in this section, linking it to the existing case-law in Latvia, which in certain cases is quite arguable. The author also clarified the notions ‘necessary’ and ‘manifestly undelayable’ assistance, looking at them from a legal point of view, as well as looking into opinions expressed in medical literature. The author paid special attention to the unjustified differences in the case-law for road traffic accident cases, when aggregation of the relevant paragraph of Section 260 of the Criminal Law and Section 141 thereof is required. The research carried out in this thesis lead to the conclusion that amendments need to be made to Section 141 of the Criminal Law in order to facilitate the application thereof in practice for criminal justice institutions.
