Abstract

Maģistra darba temats ir "Konfidencialitātes princips starptautisko šķīrējtiesu procesā". Šķīrējtiesas procesa privātā un konfidenciālā daba tiek uzskatīta par vienu no būtiskākajām šķīrējtiesu priekšrocībām un ir pamats, kas liek pusēm izvēlēties to kā alternatīvu vispārējās jurisdikcijas tiesās. The title of the present Master's Paper is "Confidentiality principle in the proceedings of international arbitration". Privacy and confidentiality are claimed to be among the most important advantages of arbitration and the primary reason why companies all over the world have used arbitration to resolve international commercial disputes, although latest tendencies show that both privacy and confidentiality in arbitration is threatened. Master's Paper includes comprehensive analysis of cases, laws and regulations and most important doctrine in different jurisdictions related to application of confidentiality principle in international arbitration emphasizing common issues and offering solutions for them
