Miruša cilvēka ķermeņa aizsardzības problemātika

Abstract

Šā pētījuma objekts ir miruša cilvēka ķermeņa aizsardzība. Necieņa pret mirušo ķermeņiem ir amorāla vispārpieņemto normu neievērošana, kā rezultātā tiek rupji pārkāpta sabiedriskā kārtība un, kas ir ne mazāk svarīgi, var arī radīt morālas ciešanas aizgājēju tuviniekiem, tādēļ atbildība par to ir paredzēta Latvijas krimināltiesiskajā regulējumā. Maģistra darba ietvaros atspoguļotas šā regulējuma nepilnības un attiecīgo nodarījumu kvalifikācijas problemātika. Maģistra darba mērķis ir izstrādāt kvalitatīvu pētījumu par cilvēka līķa aizsardzību Krimināllikuma 117.panta 5.punkta un 228.panta ietvaros, kā arī pierādīt darba sākumā izvirzīto hipotēzi, ka mirušas personas ķermeni Krimināllikums iepriekš norādītajos pantos aizsargā nepietiekami. Pētījums balstīts uz ārvalstīs spēkā esošā regulējuma aplūkošanas, tiesu prakses analīzes, kā arī uz dažādu tiesību zinātnieku viedokļu salīdzinājuma. Pētījuma gaitā apstiprinājusies darba hipotēze, kā rezultātā autore piedāvā arī veikt konkrētus grozījumus Krimināllikumā, būtiskākais no tiem - paredzēt atbildību par mirušā neapbedīšanu.

Dead persons body protection is an object of this research. Disrespect against the bodies of deads is an amoral unnotice of the generally accepted norms, as in the result the public order is rough crossed and, what is not less important, these actions can also create moral sufferings to deceaseds family and the nearest friends, therefore responsibility for those non-moral actions is provided in the Criminal Code of Latvia. Incompleteness of the above mentioned criminal regulation and problems of qualifying offences against dead persons bodies is examined in this research. Cause of this research is to realize qualitative study about protection of humans corpses within the framework of 117th paragraphs 5th item and 228th paragraph of the Criminal Code of Latvia, and also to prove hypothesis of this research – legal protection of dead persons body is not regulated completely in above mentioned paragraphs. This research is based on review of foreign countries legal regulations in the mentioned issue, on an examination of the legal practice of courts and also on a comparison of Criminal law scientists points of view. As a result of the study initial hypothesis has been approved, an author offers to execute definite changes in the Criminal Code of Latvia, prior - to determine responsibility for dead persons unfuneral.
