Maģistra darbā autore pēta pakalpojuma līgumu grupu Eiropas Kopējā modeļa projektā (DCFR), lai izdarītu secinājumus, vai nepieciešams pielāgot Civillikuma uzņēmuma līguma noteikumus atbilstoši DCFR ietvertajiem pakalpojumu līgumu noteikumiem. Autore uzskata, ka jāturpina veikt Civillikuma modernizācija, lai virzītos uz vienotu Eiropas līgumtiesību regulējumu, risinot civiltiesību sistēmas jautājumus un prakses vajadzības.
Darbā tiek apskatīts pakalpojumu jēdziens un to dalījums, analizēta DCFR pakalpojumu līgumu grupa, lai izvērtētu piedāvāto noteikumu ieviešanas nepieciešamību Latvijas normatīvajos aktos, kā arī veikta pakalpojumu līgumu tiesiskā regulējuma gan Latvijā, gan ES valstīs izpēte un identificētas problēmas Eiropas vienota līgumtiesību regulējuma ieviešanā.
Autore analizē dažādu atzītu civiltiesību zinātnieku viedokļus, galvenokārt izmantojot ES valstu literatūru, kā arī apskata ES valstu, Latvijas normatīvos aktus un tiesu praksi. Tādējādi autore pauž savu viedokli un izdara secinājumus par pētāmo tematu.
Latvijā būtu nepieciešams pilnveidot pakalpojuma līgumiem piemērojamo tiesisko regulējumu, lai atvieglotu līgumslēdzēju pušu vienošanos, atbildības noteikšanu un tiesas spriešanu, nodrošinot pusēm vienlīdzīgu tiesību un interešu aizsardzību. Šajā sakarā darba autore piedāvā savus ierosinājumus Civillikuma noteikumu, kas piemērojami pakalpojumu līgumiem, pilnveidošanai. The author of master thesis researches the scope of service contracts of the Draft Common Frame of Reference (DCFR) to draw conclusions, if it is necessary to adjust the Civil Law regulation accordance with proposed rules of the DCFR. In the author’s opinion, it should be continued modernization of the Civil Law, in order to move towards common European contract law. However, there must take into account issues of civil law system and practice needs.
In master thesis is examined the concept of service, classification of services and is analysed Chapter on Service Contracts of the DCFR, so that to assess the necessity of implementation of the proposed rules in Latvia. As well, the author is researched the legal basis of Latvia and other EU countries, identifying the problems of implementation of common rules on service contracts.
There are analysed different opinions presented by well-known Civil law scientists, mainly of the foreign countries. The paper is inspired by legislation and case law of Latvia and other EU countries. The analysis of these sources leads to several conclusions.
It is necessary to establish normative basis of service contracts in Latvia and ensure its uniform application, what would have relevant and positive impact on parties of service agreement and related case law. For this purpose, the author offers her suggestions how the legal basis in Latvia, which is applied to service contracts, could be improved.
