Pamattiesību aizsardzība ES pēc Lisabonas Līguma spēkā stāšanās

Abstract

Darba galvenais mērķis bija izpētīt, kā Lisabonas līgums ietekmējis pamattiesību aizsardzības standartu ES un dalībvalstu pienākumus šajā jomā, kā arī noskaidrot, vai tā ieviestie grozījumi piešķīra ES pamattiesībām jauno tiesisko statusu. Lai sasniegtu izvirzīto mērķi, darbā tika apskatīta gan pamattiesību aizsardzības tiesiskā regulējuma attīstība ES, gan analizēti Lisabonas līguma grozījumi un ES Pamattiesību hartas piemērošanas problemātika, kā arī izpētīti pievienošanās līguma projekta noteikumi un priekšlikumi. Darba gaitā autore secināja, ka, pirmkārt, neskatoties uz to, ka Lisabonas līgums padara ES pamattiesības redzamākas tās iedzīvotājiem un paredz tiešu un skaidru tiesisko pamatu pamattiesību aizsardzībai, attiecībā uz dalībvalstu pienākumiem savā darbībā ievērot pamattiesības, darbojoties ES tiesību piemērošanas sfērā – Lisabonas līgums neparedz jaunievedumus un būtiski nemaina šo pienākumu apjomu. Otrkārt, šobrīd ES pamattiesību un cilvēktiesību tiesiskais statuss ir līdzvērtīgs ES primārajām tiesībām, un, treškārt, Lisabonas līgums kopumā uzlaboja pamattiesību aizsardzības regulējumu ES, piešķirot iespēju ES pievienoties Konvencijai, kas, kaut gan arī būs laikietilpīgs un sarežģīts process, bet rezultātā padarīs ES vēl demokrātiskāku, norādīs uz tās cieņu pret pamattiesībām, kā arī paaugstinās saviem pilsoņiem tiesiskās aizsardzības līmeni. The main purpose of the paper was to find out how the Lisbon Treaty affected the EU standard for the protection of fundamental rights and the obligations of Member States in this respect, as well as to ascertain whether the Lisbon Treaty amendments have granted the EU fundamental rights a new legal status. In order to achieve the goal, the paper focused on the stages of development of fundamental right’s legal regulation in EU, as well as Lisbon Treaty amendments and the problem of application of EU Charter of fundamental rights have been analyzed, additionally providing the analysis of the draft accession agreement provisions and proposals. During the course of work the author of the paper has concluded that, firstly, notwithstanding that the Lisbon Treaty makes EU fundamental rights more visible to its citizens as well as provides clear and direct basis for the protection of fundamental rights, in relation to the Member State’s obligations to respect fundamental rights when they are acting within the scope of EU rights – Lisbon Treaty does not provide for any innovations and does not substantially change the scope of the obligations. Secondly, meanwhile the legal status of EU fundamental rights and human rights is of an equal value to that of EU primary law, and, thirdly, the Lisbon treaty in overall has improved the regulation of fundamental rights protection in EU, granting the possibility for EU to accede to the Convention which, although a rather time consuming and difficult process, but eventually will make EU more democratic, will show its respect towards fundamental rights as well as will increase the level of judicial protection of its citizens.
