Kriminālatbildība par ceļu satiksmes noteikumu un transportlīdzekļu ekspluatācijas noteikumu pārkāpšana

Abstract

Atslēgvārdi: transportlīdzeklis, ceļš, noziedzīgs nodarījums, salikts sastāvs, tiesību normu konkurence. Maģistra darba tēma ir „Kriminālatbildība par ceļu satiksmes noteikumu un transportlīdzekļu ekspluatācijas noteikumu pārkāpšanu”. Maģistra darbā ir pētītas un analizētas aktuālākās problēmas, kas saistītas ar noziedzīgiem nodarījumiem pret ceļu satiksmi. Darbā sīkāk tiek pētīti noziedzīgi nodarījumi, kas saistīti ar transportlīdzekļa vadīšanu reibumā, jo tas ir viens no visizplatītākajiem un bīstamākajiem nodarījumiem pret satiksmes drošību. Maģistra darbs sastāv no četrām nodaļām. Pirmajā nodaļā tiek analizēti jēdzieni „ceļš” un „transportlīdzeklis”. Otrajā nodaļā tiek analizēts Krimināllikuma 260. pantā un 262. pantā paredzētais noziedzīgā nodarījuma sastāvs – objekts, objektīvā puse, subjekts, subjektīvā puse. Trešā nodaļa ir veltīta tiesību normu konkurences analīzei, kas saistīta ar noziedzīgiem nodarījumiem pret satiksmes drošību. Ceturtajā nodaļā tiek pētīts citu valstu normatīvais regulējums, kas attiecas uz transportlīdzekļu vadīšanu reibumā. Maģistra darba katras nodaļas un apakšnodaļas beigās tiek noformulēti secinājumi, bet darba beigās tiek apkopoti secinājumi par izvēlētās tēmas pamatproblēmām, kā arī tiek piedāvāti šo pamatproblēmu iespējamie risinājumi. Maģistra darba izstrādes gaitā tika analizēti dažādi materiāli, literatūra, tiesu prakse u.c.

The theme of the master’s paper is „Criminal liability for violation of traffic provisions and provisions regarding vehicle operation”. The master’s paper deals with the research and analyses of the most topical problems connected with corpus delicty against road safety. The paper researches the corpus delicty wich are connected with driving under the influence of alcoholic substances as it is one of the most common and dangerous delinquency against road safety. The master’s paper consists of four chapters. In the first chapter deals with the terms „road” and „vehicle”. In the second chapter the elements of corpus delicty provided by Criminal law article 260 actus reus and mens rea have been analysed. The third chapter is dedicated to the analyses of legislative provisions competition connected with the corpus delicty against road safety. In the fourth chapter the author has researched the normative rules of other countries referring to driving under the influence of alcoholic substances. The conclusions were formulated at the end of each chapter and subchapter of the master’s paper, but the conclusions about the main problems of the choosen theme where summarised as well as the possible solutions to these problems were offered at the end of the paper. While working on the master’s paper various materials, literature, court practice etc. were analysed.
