Maģistra darba „Bāriņtiesas loma nepilngadīgo personu mantisko tiesību aizsardzībā” autores pētījums ir vērsts uz bāriņtiesas darbībām nepilngadīgo personu mantisko tiesību un interešu aizsardzībā. Saskaņā ar Latvijas Republikā noteikto normatīvo regulējumu bāriņtiesa kā bērna mantisko interešu aizsardzības institūcija pieņem lēmumus par atļauju pieņemt vai atraidīt bērna vārdā viņam piekritušo mantojumu, par mantojuma sadalīšanu, par bērnam piederošās mantas atsavināšanu, bērna mantas ieķīlāšanu vai apgrūtināšanu ar lietu tiesībām, par īpašuma iegūšanu bērnam un veic daudzus citus mantisko tiesību aizsardzības pasākumus.
Maģistra darba mērķis ir izpētīt nepilngadīgo personu mantas pārvaldības īpatnības, sniegt un analizēt piemērus no bāriņtiesu un tiesu prakses, aplūkot Latvijā esošo normatīvo regulējumu attiecībā uz bāriņtiesu kompetenci nepilngadīgo personu mantisko interešu nodrošināšanā, konstatēt bāriņtiesu praksē esošos trūkumus vai nepilnības, šo trūkumu novēršanai izteikt priekšlikumus normatīvo aktu grozīšanai. Pētījums ir vērsts uz to, lai atklātu nepieciešamās darbības un uzdevumus, kas būtu jāveic, jāuzlabo vai jāpapildina, lai bāriņtiesu darbību nepilngadīgo personu mantiskajās lietās padarītu efektīvāku.
Maģistra darbs sastāv no trīs nodaļām, kurās apskatītas tādas tēmas kā nepilngadīgo personu tiesiskais statuss mantiskajās lietās, nepilngadīgo personu pārstāvība mantiskajās lietās, bāriņtiesas kompetence praksē visbiežāk esošajās lietās par bērna mantas pārvaldību un bāriņtiesas kā uzraudzības iestādes kontrole nepilngadīgo personu mantiskajās lietās. Maģistra darba noslēgumā izvirzīti darba autores secinājumi un priekšlikumi apzināto problēmjautājumu risināšanā.

Author’s research of the masters’ paper on “The role of Orphans Court in ensuring the substantive interests of minors” examines the operation of Orphans Courts in terms of protecting the property law and interests of minors. In accordance with the applicable normative regulation of the Republic of Latvia, a Orphans court as an institution who protects the substantive interests of a child, adopt decisions on permitting to accept or decline property pertaining to a child on behalf of such a child, on division of property, on forfeiture of child’s property, on encumbering or applying rights of things to the property of a child, on acquisition of property on behalf of child as well as many other substantive law protection related undertakings.
The goal of the masters’ paper was to examined the specifics of governing minor persons’ property, present and analyse samples from the practice of Orphans Courts and courts, review the existing normative regulation in Latvia concerning the competence of Orphans Courts in terms of ensuring the substantive interests of minor persons, identify existing drawbacks and insufficiencies in Orphans Court practice and set forth recommendations for amendments of applicable normative acts avert the said insufficiencies. The study is focused in such a manner that it would reveal the necessary actions and tasks that shall be undertaken, improved or complemented in order to increase the Orphans Court operation concerning the substantive law of minor persons.
The masters’ paper consists of three principal chapter that review such topics as the legal status of minor persons in substantive cases, the competence of Orphans Court in the most frequent cases in practice on governing child’s property and Orphans Court’s role as a supervision establishment control in the substantive cases of minor persons. The conclusive part of the paper presents principal conclusions drawn by the author and recommendations to tackle the identified issues.
