Noziedzīgu nodarījumu pret dzimumneaizskaramību kvalifikācijas problēmas

Ar 2009.gada 1.jūliju spēkā stājas būtiski grozījumi mūsu valsts Krimināllikumā, kas skāra arī nodaļu par nodarījumiem pret tikumību un dzimumneaizskaramību. Ņemot vērā minēto, autore uzskata, ka izvēlētā maģistra darba tēma ir aktuāla. Par maģistra darba aktuālitāti liecina arī statistikas dati, kuri publicēti Latvijas Republikas Iekšlietu ministrijas informācijas centra mājas lapā. Latvijā joprojām ir aktuāla dzimumnoziegumu tēma. No statistikas datiem var spriest, ka visvairāk no seksuālās vardarbības bija apdraudētas nepilngadīgas personas (bērni).
Maģistra darba mērķis ir, izmantojot salīdzinošo analīzi ar ārvalstu krimināllikumiem un konstatējot kopīgas un atšķirīgas pazīmes, izprast Krimināllikuma 159. un 160.panta darbības efektīvītāti un iezīmēt identificēto problēmu risinājumu vadlīnijas.
Krimināllietu materiāli apstiprināja, ka praksē vēl arvien nav vienveidīgas izpratnes par analizējamo noziedzīgo nodarījumu sastāva pazīmēm, kā rezultātā tiek pieļautas kļūdas noziedzīgo nodarījumu kvalifikācijā. Tiesu praksē viens no sarežģītākajiem kvalifikācijas jautājumiem ir Krimināllikuma 160. un 162.pantā paredzēto nodarījumu norobežošana. Visai līdzīgas darbības un situācijas praksē, pie tam, gan pirmstiesas kriminālprocesā, gan arī tiesā, ne vienmēr tiek kvalificētas vienveidīgi.
Izpētot pastāvošo tiesu praksi, jāsecina, ka izvarošana netiek uzskatīta par atkārtoti izdarītu, ja tā izdarīta vairākkārt ar vienu un to pašu personu, vienā vai dažādās vietās, taču laika ziņā nav bijis ilgāks pārtraukums, ja šādas darbības aptver vainīgā vienots nodoms. Tomēr ir jāatzīmē, ka cietušajai personai tas ir atkārtots pret viņas gribu izdarīts dzimumakts, kura rezultātā tiek no jauna tīši nodarīts kaitējums cietušā dzimumbrīvībai, no jauna sagadā psihiskus un emocionālus pārdzīvojumus un ciešanas, it īpaši gadījumos, kad izvarošana notiek personu grupā. Pirmais variants, ka atrisināt šo kvalifikācijas problēmu, ir vairākkārtīgi izdarītu izvarošanu uzskatīt par atkārtoti izdarītu noziedzīgu nodarījumu. Otrais iespējamais šo kvalifikācijas problēmu risinājums ir izdarīt Krimināllikuma 159. un 160.pantā izmaiņas, ieviešot vēl vienu kvalificējošo pazīmi, paredzot par to sodu līdzīgu tam, ja tas izdarīts atkārtoti.

159.pantā: izteikt otrās daļas dispozīciju šādā redakcijā:
(2) Par izvarošanu, ja ta izdarīta vairākkārtīgi, vai ja to izdarījusi personu grupa, kā arī par nepilngadīgā izvarošanu.
160.pantā: izteikt otrās daļas dispozīciju šādā redakcijā:
(2) Par tādām pašām darbībām, ja tās izdarītas ar nepilngadīgo vai izdarītas vairākkārtīgi, vai ja tās izdarījusi persona, kas jau agrāk izdarījusi izvarošanu, vai ja tās izdarījusi personu grupa. On July 1st, 2009 essential amendments to the Criminal Law came into force, among them also concerning criminal offences against morality and sexual inviolability. Taking into account the above-mentioned the authoress considers that the subject of the thesis is a very actual theme nowadays. There are also statistical data on the home page of the Ministry of Home Affairs of the Republic of Latvia testifying the actuality of the thesis, as well as the fact that the theme of criminal offences against sexual inviolability is still actual in Latvia. As is obvious from statistical data the majority of persons suffering from sexual abuse are under age.
The purpose of the thesis is to investigate the regulations of criminal laws of other countries and to perform a comparative analysis of them and the Criminal Law, to reveal common and different features; to investigate the efficiency of Articles 159 and 160 of the Criminal Law and to suggest possible guidelines of revealed problems’ solutions.
The materials of analyzed criminal cases have confirmed that there still doesn’t exist an united concept of indications of crime in the acts, as a result of what there is a possibility of making mistakes while qualifiyng the above mentioned criminal offences. One of the most difficult questions in court practice is the differentiation of criminal offences provided in Articles 160 and 162 of the Criminal Law. Resembling actions and situations are not always being qualitied similarly both in pre-trial investigation and during the trial.
After investigation of actual court practice it can be concluded that rape cannot be considered as committed iteratively in case if it was committed several times, but with the same person in one or several places, within a short period of time and if these actions can be united in guilty person’s common intent. However it’s clear that for a victim such actions are repeated sexual acts committed against his will, as a result of which his right to sexual inviolability is being violated again, moral and physical suffering are being caused to him again, especially in cases when rape is being committed by the group of persons.
The first possible method of solving this problem is to consider iteratively committed rape as a iteratively committed criminal offence. The second method could be making of changes in Articles 159 and 160 of the Criminal law, adding one more qualifying feature, providing for that penalty resembling to the one which is being applied in case of iteratively committed criminal offence. For example, to express the disposition of the second part of Article 159 in the following edition:
(2) For rape committed iteratively or committed by the group of persons of for the rape of person under age.
To express the disposition of the second part of Article 160 in the following edition:
(2) For the same actions, if they were committed with person under age or committed iteratively or committed by person previously accused for rape, or committed by the group of persons.
