Autors izvēlējās maģistra darba tēmu „Pierādījumu un pierādīšanas civilprocesuālie aspekti”. Autors apskata vispārīgos noteikumus par pierādījumiem. Īpaša uzmanība pievērsta pierādījumu un pierādīšanas jēdzieniem. Secināts, ka viens no svarīgākajiem jautājumiem pierādīšanas procesā ir pareiza pierādīšanas priekšmeta un tā robežu noteikšana.
Autors noskaidro kādi ir civilprocesuālās tiesvedības un pierādīšanas mērķi. Autors nepiekrīt zinātnieku vairākumam, ka pierādīšanas mērķis civilprocesā ir patiesības noskaidrošana. Darbā tiek norādīts uz objektīviem šķēršļiem patiesības noskaidrošanas iespējamībai civilprocesā. Tiek secināts, ka patiesības noskaidrošana nav galvenais un vienīgais pierādīšanas mērķis.
Pētījuma rezultātā autors piedāvā pierādīšanas pienākuma sadalījumu starp lietas dalībniekiem iedalīt vispārīgajā un speciālajā. Autors secina, ka pierādīšanas subjekti ir ne tikai lietas dalībnieki, bet arī pati tiesa bez kuras pierādīšanas process nav iedomājams. Tiek analizēta tiesas loma pierādīšanas procesā. Balstoties uz ārvalstu likumdevēju pieredzi, autors piedāvā paplašināt tiesas funkcijas pierādījumu iegūšanā. Tajā pašā laikā saglabājot sacīkstes principa vadošo lomu Latvijas civilprocesā.
Tāpat autors pievēršas pierādījumu attiecināmības jautājumam. Tiek piedāvāti risinājumi, lai civillietas netiktu pārpildītas ar materiāliem, kuriem nav nekādas nozīmes lietas izspriešanā. The author has selected the following topic for his master's paper: «The civil procedural aspects of evidence and proving. » The author reviews the general provisions on evidence. Particular attention is paid to the notions of evidence and proving. It is concluded, that one of the most important issues during the proving procedure is the correct definition of the subject of proving and its limits.
The author clarifies the objectives of civil proceedings and proving. The author does not agree to the majority of the scientists, that the objective of proving during the civil procedure is the clarification of the truth. The paper indicates the objective obstacles for the probability of the clarification of the truth during civil procedure. It is concluded, that the clarification of the truth is not the main and the only objective of proving.
As a result of the research, the author offers the distribution of the proving responsibility into the general and the special ones between the participants of the case. The author concludes, that the subjects of proving are not only the participants of the case, but also the court itself, without which, the proving procedure is inconceivable. The role of the court in the proving procedure is analyzed. Basing on the experience of the foreign legislators, the author offers to expand the court functions in the evidence acquisition, while preserving the leading role of the principle of competitiveness in the civil procedure of Latvia.
The author also focuses on the issue of evidence applicability. Solutions are offered, so that civil cases are not overfilled with the materials, which have no importance in the case adjudication.
