Krimināllikuma 125.panta trešajā daļā paredzētā noziedzīgā nodarījuma norobežošana no slepkavības un nonāvēšanas aiz neuzmanības

Lai arī šķiet, ka darbā aplūkotie Krimināllikuma panti jau pēc normas dispozīcijā norādītajām pazīmēm ir pietiekami atšķirīgi un skaidri nošķirami, turklāt ir veikti dažāda veida apkopojumi un ieteikumi par šo strīdīgo pantu nošķiršanu, tiesu prakse rāda, ka vēl joprojām tiesību piemērotājiem ir tendence vispusīgi neizvērtēt noziedzīgā nodarījuma sastāvu (biežāk, subjektīvās puses pazīmes), līdz ar to tiek noteikta nepareiza šo noziedzīgo nodarījumu kvalifikācija. Autore secina, ka KL 125.panta trešajā daļā ietvertais nodarījums pēc savas būtības ir samākslota konstrukcija, jo atšķirībā no citiem noziedzīgiem nodarījumiem ar divu veidu sekām, šajā nodarījumā pirmās sekas ir ļoti cieši saistītas ar otrām sekām, kur ne reti nav iespējams tās norobežot. Tiesu prakse uzskatāmi rāda, ka liela daļa noziedzīgo nodarījumu tiek kvalificēti nepievēršot pienācīgu rūpību, kā rezultātā ļoti diskutabls kļūst darba ievadā minētais zemais slepkavību skaits valstī, jo iespējams liela daļa noziedzīgo nodarījumu tiek nepareizi kvalificēta saskaņā ar KL 125.panta trešo daļu, līdz ar ko reālais slepkavību skaits varētu būt pat uz pusi lielāks. Although it seems that the Articles discussed in this Master’s Thesis are rather different and seem clearly distinguishable by the specific predisposition mentioned in the Article, moreover, taking into consideration that there have been several summaries and recommendations on this issue, the case law shows that there is still a problem drawing a distinction between these Articles. The problem arises from the less comprehensive consideration (more often, mens rea).
The author concludes that Part Three of the Criminal Law Article 125 is an artificial construction, in comparison to other offences that present two types of consequences, because the consequences in this Article are very closely related to each other, so it becomes fairly impossible to separate them. The case law shows that a significant part of the mentioned crimes are differentiated without the proper attention they require, and as a result the number of murders mentioned in the Master’s Thesis is greatly disputable. A significant part of these crimes are wrongly recognized as relating to the Part Three of the Criminal Law Article 125, therefore the actual number of murders could be greater even by a half.
