Atziņa, ka bērni ir nākotne, šķiet tiek pieņemta kā vispārzināma patiesība. Bērni ir tie, kas ar savu radošu darbu un tikai ar sev raksturīgiem individualizācijas līdzekļiem un izziņas rezultātiem atspoguļo sabiedrības materiālas un garīgas vērtības. Šis darbs ir veltīts nepilngadīgo autoru vecumā no 16-18 gadiem tiesību analizēšanai autortiesību korelācijā ar bērnu tiesībām, rīcībspējas institūtu, lietu tiesībām un konstitucionāla ranga normām. Šobrīd Latvijā nepilngadīgo autoru tiesības patstāvīgi pārvaldīt savas autortiesības ir „iekodētas” Civillikumā, kas nedod pietiekamu tiesisku skaidrību un noteiktību. Šo situāciju varētu labot, papildinot Autortiesību likumu ar tiesību normu, kas saturiskā līmenī būtu līdzīga citu valstu normām, kas veiksmīgi risina šo jautājumu. Turklāt, nepilngadīgo autoru tiesību realizācija Latvijā pazīstama kopš 1864.gada, tomēr Civillikums šo ideju nav pārņēmis ne no Vietējā Civillikuma kopojumā, nedz no Latvijas PSR Civilkodeksa.

Children are the ones who reflect the financial as well as moral values of society through their creative work and their own typical means of individualization. The rights of minor authors demonstrate not only the present development trends in the field of copyright but also protection of the basic rights and the rights of the child of which all potential users of the author’s work as well as the author should be aware. The Master Thesis “Rights of minor authors: peculiarities, problematic and actualities” has been developed as a pragmatic yet theoretical study of recommending nature. The author of the work expects the conclusions contained in the Thesis to serve as basis for handling of the given matter by practicioners. The considerations described and conclusions made provide sufficient basis not only for public debates but also for assessment of the rights of minor authors from other aspects in the work of lawyers and the court, thus fostering improvement and further development of the law.
