Maģistra darba ir skarta viena no pašreizējā brīdī aktuālākajām problēmām krimināltiesību sfērā – par atteikšanos no mantas konfiskācijas kā soda, kā arī aplūkotas procesuālās problēmas, ar kurām saskarās zvērināti tiesu izpildītāji savā ikdienas darbā izpildot mantas konfiskāciju. Darba autors aplūko soda institūta vēsturisko attīstību, soda jēdzienu un saturu, apskata soda noteikšanas principus. Tiek noskaidrots mantas konfiskācijas jēdziens un analizēti iemesli kādēļ mantas konfiskācija nonāk pretrunā ar Satversmes 105. pantu un starptautiskajiem tiesību avotiem. Kā viens no galvenajiem iemesliem tiek norādīts tas, ka tādējādi būtībā bez tiesiska pamata tiek ierobežotas personas tiesības uz īpašumu kā arī daudzos gadījumos tiek aizskatas ģimenes kā arī trešo personu tiesības un intereses. Autors apzina būtiskākās problēmas mantas konfiskācijas soda izpildes gaitā un cenšas sniegt iespējamos to risinājumus. This dissertation considers and investigates an area of concern in criminal law; the use of the penalty of confiscation of belongings or property as a tool of punishment. It also concentrates on the problems which bailiffs face during their daily work while completing the confiscation procedure as it exists. The author investigates the history and the development of the term “penalty”. The reasons and conditions for applying the penalty are explored in detail. “Confiscation of property” is scrutinised and the reason why this term is controversial to the Constitutional Act 105 is examined. One of the main reasons for the controversy is that personal rights to property are limited without acceptable explanation. In many cases the rights and privacy of third persons and/or family are violated. The author lists the major problems which are faced during the confiscation process of belongings and properties and tries to make suggestions for improvements.
