Kopīpašuma izbeigšanas regulējuma modernizēšanas iespējamie virzieni un nepieciešamība Latvijas Republikas Civillikumā

Maģistra darba ietvaros ir veikta kopīpašuma izbeigšanas regulējuma izpēte. Pirmkārt, īsi pievēršoties kopīpašuma dalīšanas pirmsākumiem romiešu tiesās. Otrkārt, vērtējot pašreizējo regulējumu un tiesu praksi Latvijas Republikā. Treškārt, apskatot kopīpašuma izbeigšanas regulējumu ārvalstīs. Visbeidzot, piedāvājot konkrētus Latvijas Republikas Civillikuma modernizācijas virzienus, izstrādājot Civillikuma pantu jaunas redakcijas.
Darbā ir izvērtēts, cik efektīvs un praktisks ir pašreizējais kopīpašuma izbeigšanas regulējums. Problēmjautājumi, kas pastāv praksē un teorijā, skaidri norāda, ka ir nepieciešams pilnveidot Civillikuma regulējumu, lai nodrošinātu pēc iespējas efektīvu un taisnīgu kopīpašnieku interešu aizsardzību. The author has carried out a survey on regulation of termination of co-ownership. Firstly, the author has briefly addressed the regulation in Roman law. Secondly, the current regulation and case law in the Republic of Latvia was evaluated. Thirdly, the author has researched the regulation of termination in other countries. Finally, the paper proposes precise ways how the Civil Law of the Republic of Latvia can be modernized by preparing new Articles of the Civil Law.
In the paper it is evaluated how effective and practical is the current regulation on termination of co-ownership. The problematic issues in practice and theory clearly show that it is necessary to further develop the regulation of Civil Law to ensure the protection of interests of co-owners to be as effective as possible.
