Konvencijas robu aizpildīšana ar vispārējiem principiem saskaņā ar CISG 7. panta otro daļu

Abstract

Galvenā problēma Konvencijas piemērošanā pastāv robu aizpildīšanā jautājumos, kas attiecas uz ar šo konvenciju regulējamiem jautājumiem, kuri nav tieši noteikti tajā. Maģistra darba mērķis ir apskatīt Konvencijas robu aizpildīšanas metodes, par piemēru ņemot procentu likmi. Sakarā ar minēto darba uzdevumi ir apskatīt robu aizpildīšanas ar vispārējiem principiem, Unidroit principiem un pēc analoģijas teorētiskus aspektus, un salīdzināt kā šīs metodes tiek piemērotas praksē. Tika secināts, ka: 1)nosakot piemērojamo procentu likmi, var balstīties uz dažiem vispārējiem principiem, kuri ir Konvencijas pamatā; 2)nosakot procentu likmi, var piemērot arī citus Konvencijas pantus pēc analoģijas, kas sekmēs Konvencijas autonomu aizpildīšanu un Konvencijas normu vienveidīgu piemērošanu. 3)nosakot procentu likmi, Unidroit principu normu piemērošana lai interpretētu un papildinātu Konvencijas regulējumu nav nepieciešama, tāpēc, ka pēc detalizētās analīzes redzams, ka šo robu var aizpildīt izejot no pašas Konvencijas.

The main problem in the application of the Convention is filling gaps in the matters governed by this Convention which are not expressly settled in it. The purpose of the work is to consider some methods of filling a Convention gap on the example with the interest rate. Therefore, the tasks of the work are the examination of the theoretical aspects of filling in the gaps with the general principles, UNIDROIT principles, by analogy and to compare how the methods can be applied in practice. It was concluded that: 1) Several principles on which the Convention is based can be used to determine the applicable interest rate; 2) In determining the interest rate may apply other articles of the Convention by analogy, which contributes to the autonomous application of the rules of the Convention and homogeneous filling of the Convention’s articles; 3) The application of the UNIDROIT Principles as a means to interpret and supplement the Convention was not necessary, because after the detailed analysis, it was clear that the gaps can be filled on the basis of the Convention itself.
