Pētījums aplūko Padomes regulu nr.44/2001 par jurisdikciju un spriedumu atzīšanu un izpildi civillietās un komerclietās. Galvenā pētījuma daļa koncentrēta 5(1) panta aplūkošanai un problēmām, kā arī regulējuma pirmsgājēja 1968.gada Konvencijas par jurisdikciju un spriedumu atzīšanu un izpildi civillietās un komerclietās analoģiskām normām.
Pētījumā aplūkota problemātika, kas sastopama alternatīvās jurisdikcijas notiekumu piemērošanā, respektīvi, piemērošanas joma, atsevišķie jautājumi, kas attiecas uz Briseles Konvencijas 5(1) un Briseles I regulas 5(1) b) apakšpunkta tulkošanas niansēm, attiecīgās saistības definēšana, izpildes vieta, laiks u.c. jautājumi. Analizēta arī jaunākā tiesu prakse, kas attiecas uz vairāku saistības izpildes vietu notiekšanu.
Pētījumā secināts, ka starp Briseles Konvenciju un Briseles I regulu pastāv zināma līdzība, neskatoties uz jauninājumiem notiekumos. Izvērtēti notiekumu attīstības ceļi.
Papildus aplūkoti arī jautājumi, kas attiecas uz saistību novērtēšanas kritēijiem, kā arī tiesas vietas noteikšanas jēdziena plašumu.
Kopsavilkumā papildus secinājumiem, piedāvāti redakcionāli grozījumi, kā arī Briseles I regulas 5(1) panta piemērošanas shematisks attēlojums, ņemot vērā jauninājumus. The research paper is determined to find and analyze actual problems found in Council regulation No.44/2001 on jurisdiction and the recognition and enforcement of judgments in civil and commercial matters, especially concerning problems in Article 5(1) and to research analogous rules in the 1968 Convention on jurisdiction and the recognition and enforcement of judgments in civil and commercial matters.
The research is concerned with recognizing problems of the rules of the alternative jurisdiction, especially application, separate questions concerning the interpretation of Art 5 of the Brussels Convention and Art 5(1) b) of the Regulation 44/2001, the definition of the „obligation in question,” and other topics. The newest case law that refers to obligations with multiple places of performance has been reviewed.
The research paper contains a conclusion that several similarities remain between the Brussels convention and the regulation 44/2001, including the areas, which were problematic when applying the former regulation.
Additionally the questions regarding the scope of the criteria evaluating the understanding of an obligation and the place of performance of an obligation was analyzed.
Conclusions also contain a schematic material, including the latest developments in understanding the Article 5(1) of the Regulation 44/2001, to ease the understanding and application of the rules.
