Rīcībspēja kā personai piešķirta tiesība bauda īpašu tiesisku aizsardzību un izņemot likumā paredzētus gadījumus, rīcībspēju pilngadīgai personai nevar ierobežot. Ņemot vērā starptautiskās saistības, ko uzņēmusies Latvija cilvēktiesību jomā, radās nepieciešamība izdarīt izmaiņas nacionālajā tiesiskajā regulējumā, lai nodrošinātu mazāk aizsargāto pilngadīgo fizisko personu aizsardzību, līdz ar to Civillikumā izdarīti apjomīgi grozījumi, paredzot Latvijas tiesību sistēmā jauna tiesību institūta - ierobežota rīcībspēja, ieviešanu.
Maģistra darba mērķis ir, interpretējot Civillikuma un Civilprocesa normas par fizisko personu rīcības spējas ierobežošanu un analizējot citu valstu tiesību aktus, izdarīt secinājumus par iespējamajām problēmām tiesiskajā regulējumā un sniegt iespējamos problēmu risinājumus.
Maģistra darbā analizēta fiziskas personas rīcībspējas ierobežošanas jēga un būtība, rīcībspējas ierobežošanas apjoms un jomas, kurās rīcībspēja nosakāma, analizēta personas ar rīcībspējas ierobežojumu darījumspēja un deliktspēja, kā arī civilprocesuālā rīcībspēja, meklējot un iesakot iespējamos papildinājumus un precizējumus normatīvajos aktos attiecībā uz fizisko personu rīcībspējas ierobežošanu.
Civillikums neparedz nevienu alternatīvu rīcībspējas ierobežošanai, līdz ar to personas mantisko un nemantisko interešu aizsardzības nolūkā tās rīcībspēja ir jāierobežo tādā veidā, kas it kā varētu būt personas interesēs. Personai rīcībspēja ir maksimāli jāsaglabā, nepieciešamības gadījumā tā var tikt ierobežota tikai tādā apmērā, kāds ir nepieciešams personas interešu aizsardzībai, un tikai tajās jomās, kurās persona nav spējīga patstāvīgi pieņemt lēmumu.
Maģistra darba rezultātā izdarīts secinājums, ka persona ar rīcībspējas ierobežojumu spēs īstenot savu rīcībspēju tajās jomās, kurās tā nav ierobežota, tikai tādā apmērā, kādā tā būs spējīga apzināties un īstenot tai piešķirtās tiesības.
Atslēgas vārdi: rīcībspēja, ierobežota rīcībspēja Legal capacity as a right granted to a person enjoys special legal protection and, except cases provided under the law, legal capacity of a major person cannot be restricted. Having regard to international liabilities undertaken by Latvia in the field of human rights, a need arose make amendments to the national legal regulation to ensure protection of less protected individuals, therefore significant amendments were made to the Civil Law envisaging the implementation of an institute of law in the Latvian law system – restricted legal capacity.
The purpose of the master’s paper is, by interpreting provisions of the Civil Law and the Civil Procedure Law regarding restriction of legal capacity of individuals and analyzing statutory instruments of other countries, to make conclusions about possible problems in legal regulations and to provide possible solutions to the problems.
The master’s paper analyzes the sense and nature of restriction of legal capacity of an individual, the scope of restriction of legal capacity and fields in which legal capacity may be determined; analyzes transactional capacity and delictual capacity of a person with restricted legal capacity, as well as civil procedure legal capacity, by searching and recommending possible additions and updates to regulatory enactments related to restriction of legal capacity of individuals.
The Civil Law does not envisage any alternatives for restriction of legal capacity, therefore, for the purposes of protection of person’s material and non-material interests, his or her legal capacity shall be restricted in such a way for it to be in the interests of this person. Persons must keep their legal capacity to a maximum extent; if required, it may be restricted only to such extent to protect interests of this person and only in fields in which the person is not able to make decisions independently.
As a result of the master’s paper, a conclusion was made that a person whose legal capacity is restricted will be able to implement his or her legal capacity in the fields it is not restricted and only to the extent he or she will be able to aware of and to implement rights granted to him or her.
