Rīcības attiecināmība miera operācijās

Abstract

Darba mērķis ir analizēt rīcības attiecināmības institūtu miera operācijās, kā starptautiskās atbildības iestāšanās priekšnoteikumu un starptautisko organizāciju atbildības īstenošanas problemātiku. Šajā darbā termins „miera operācijas” tiks lietots kā vispārējs termins, kas apzīmē plašu starptautiskā miera un drošības uzturēšanas operāciju klāstu, iekļaujot tradicionālās miera operācijas līdz pat miera ieviešanas operācijām. Darbs ir sadalīts piecās nodalās. Pirmaja nodaļā tiks aplūkota starptautisko organizāciju tiesībsubjektība un rīcības attiecināmības pamati, nonākot pie secinājuma kurš attiecināmības pamats aplūkojams miera operāciju ietvaros. Otrajā nodaļā tiks aplūkots efektīvas kontroles kritērijs, savukārt trešajā nodaļā tiks vērtēta efektīvās kontroles kritērija piemērošana judikatūrā. Ceturtajā nodaļā autore vērtēs daudzpusējas un divpusējas attiecināmības iespējamību un attiecīgi divpusējas un daudzpusējas atbildības īstenošanas iespējamību. Piektajā nodaļā tiks vērtētas ANO privilēģijas un imunitātes un Apvienoto Nāciju organizācijas starptautiskās atbildības īstenošanas iespējamība.

The aim of this work is to analyse attribution of actions in peace operations as precondition of international responsibility and issues of implementation of international responsibility. In this work term „peace operations” will be used as general term, which describes extensive range of international peace keeping operations, including traditional peace keeping operations up to peace enforcement operations. The study is divided into five chapters. First chapter is concerned to separate legal personality of international organizations and articles on attributions of counduct to internationational organisations, as a result identifying which articles on attribution of conduct are used for the purposes of peace operations. The second chapter is concerned to analysis of effective control criterion and the third chapter respectively is concerned to application of effective control criterion in judicial decisions. In the fourth chapter auuthor explores possibility of bilateral and multiple attribution will be analysed, including possibility of bilateral and multiple responsibility. And at last but not least in fifth chapter author analyses UNO privileges and immunities and implementation of international responsibility of UNO
