Maģistra darbs ”Īpašuma tiesību ierobežošanas samērīgums teritorijas plānošanā” aplūko vienu no aktuālākajām problēmā ar ko sabiedrībai nācies saskarties pēdējās divās dekādes, proti, nodrošināt ekonomisko attīstību vienlaicīgi saglabājot vides (floras un faunas) bioloģisko daudzveidību. Par samērīguma izvērtēšanas kritēriju autors ir izvēlējies teritorijas plānošanu. Teritorijas plānošana ir īpašuma izmantošanas tiesību ierobežojums, jo ar teritorijas plānojumu tiek ierobežota īpašuma brīva un netraucēta izmantošana. Īpašuma tiesību ierobežojumu samērīgumu konstatēšanai izvērtējams vai ierobežojumi pieņemti ievērojot teritorijas plānošanas procesuālās normas.
Darba iztirzājuma daļā, tiek analizēta Satversmes tiesas spriedumi lietās, kas attiecas uz īpašuma tiesībām un tiesībām dzīvot labvēlīgā vidē. Spriedumos autors aplūkojis īpašuma tiesības ierobežojošās normas konstitucionalitātes izvērtēšanas metodoloģija. Master's work "The proportionality of property rights limiting spatial planning" deals with one of the most actual problems of the society experienced in the last two decades, which is to ensure economic development while preserving the biodiversity of the environment (flora and fauna). The author has chosen the spatial planning for the criteria of the evaluation of the proportionality. Spatial planning is a restriction on the use of property rights as the land use plan limits the free and unhindered use of the property.The limitation of property rights is proportionate to detect assessed or restrictions adopted in accordance with the procedural rules of land use planning.
In the discussion part Constitutional Court's case-law in matters relating to property rights and the right to live in a enabling environment is analyzed. Judgments The author analyses the ownership of restrictive rules of the constitutionality of the assessment methodology.
