Maģistra darba tēma ir piedziņas vēršana uz nekustamo īpašumu, apskatot tādus jautājumus kā piedziņas vēršana uz laulāto kopmantu un piedziņas vēršana uz nekustamo īpašumu, kas saskaņā ar Maksātnespējas likuma 148.pantu noteikts kā parādnieka mājoklis.
Šobrīd Civilprocesa likuma normas paredz iespēju vērst piedziņu uz laulāto kopmantu nenosakot kādu īpašu kārtību, kā tas jāizpilda. Parādnieka laulātā netiek uzskatīta par parādnieci saskaņā ar materiālajām tiesībām, kā arī netiek norādīta izpildu dokumentos. Līdz ar to, vēršot piedziņu uz šādu nekustamo īpašumu, tiek pārkāptas laulātā tiesības uz taisnīgu tiesu.
Tāpat arī Civilprocesa likuma un Maksātnespējas likuma normas nerod konsekvenci par to, kas tad uzskatāms par personas mājokli un kas par dzīvesvietu. Šis jautājums atstāts pašas personas ieskatā un brīvā izvēlē.
Darba uzdevums bija izpētīt, kāds būtu efektīvākais risinājums, vēršot piedziņu uz laulāto kopmantu, un kādas ir situācijas, kad persona Maksātnespējas procesa ietvar The title of Master's paper is the recovery process of real estate, focusing on the common property of the spouses and property which according to the Article 148 of the Insolvency Law is defined as the debtor's home.
At present, the Law of Civil Procedure prescribes the possibility to execute the recovery against the common property of the spouses, though without any additional rules of procedure. The debtor's spouse is not considered as debtor in accordance with the substantive law, nor is recorded in the enforcement documents. Therefore, executing the recovery on common property, the spouse's rights to a property fair trial is violated.
Similarly, rules of the Law of Civil Procedure and Insolvency Law are not consequent distinguishing the legal interpretation of persons home and domicile (place of residence). This issue is left to the person's own free choice.
