Trešo valstu pilsoņu tiesības Eiropas Savienībā saskaņā ar Eiropas Parlamenta un Padomes direktīvu 2004/38/EK

Abstract

Maģistra darbs pēta problēmas saistībā ar trešo valstu pilsoņu tiesībām saskaņā ar direktīvu 2004/38/EK par Savienības pilsoņu un viņu ģimenes locekļu tiesībām brīvi pārvietoties un uzturēties dalībvalstu teritorijā. Tiek analizētas direktīvas piemērošanas īpatnības, ievērojot ES tiesību attīstību un Eiropas Savienības tiesas lomu direktīvas interpretācijā, dažkārt izraisot dalībvalstu neapmierinātību. Lai padarītu tēmu konkrētāku, maģistra darbs apskata, kā direktīva ir ieviesta Latvijā, kā arī kāds ir tās iespaids uz trešo valstu ģimenes locekļu ieceļošanu dalībvalstīs, de facto atceļot daudzus nacionālos un Šengenas imigrācijas noteikumus.

The thesis examines problems related to the rights of non-EU citizens under the Directive 2004/38/EC on the right of citizens of the Union and their family members to move and reside freely within the territory of the Member States. It analyses the peculiarities related to the applicability of the Directive in light of the development of the EU law and the role of the Court of Justice of the European Union in interpreting the directive sometimes rising discontent of the Member States. In order to put more flesh on the subject, the thesis explores the way the Directive was implemented in Latvia and the repercussions it has on the entry of third country family members into the Member States de facto repealing many both national and Schengen immigration provisions.
