Uzturlīdzekļi bērnam: Latvijas pieredze salīdzinājumā ar citām Eiropas valstīm

Abstract

Maģistra darba tēma ir uzturlīdzekļi bērnam: Latvijas pieredze salīdzinājumā ar citām Eiropas valstīm. Lai arī daudz diskutēts, šis joprojām ir ļoti aktuāls temats. Maģistra darba mērķis ir izpētīt galvenos problēmjautājumus Latvijas normatīvajos aktos attiecībā uz uzturlīdzekļiem bērnam. Darbā ir sniegti priekšlikumi, kā uzlabot uzturlīdzekļu bērnam piedziņu. Maģistra darbā ir arī analizēta Latvijas tiesu prakse jautājumā par uzturlīdzekļu piedziņu bērnam. Darbā pētīta vairāku Eiropas valstu pieredze uzturlīdzekļu bērnam piedziņas jautājumos, kā arī uzturlīdzekļu piedziņas jautājumi Eiropas Savienības ietvaros. Ir veikta analīze, kā labākās Eiropas valstu idejas iekļaut Latvijas normatīvajos aktos. Vienā maģistra darba nodaļā tiek runāts par Uzturlīdzekļu garantiju fondu un problēmām tā darbā.

The topic of the master paper is maintenance for children: Latvian experiance in comparison with other European states. Although much discussed this is still actual topic. The purpose of the paper is to research the main problem cases about the maintenance for children in Latvian legislation. The suggestions have been made how to improve the collection of maintenance for children. The practice of Latvian court cases with regard to maintenance for children have been also researched in the paper. The experiance of European states as weel as mechanism in the framework of European Union towards collection of maintenance of children have been analysed in the paper. The analysis is made with purpose how to incorporate the best ideas from other European states in Latvian legislation. One chapter of the paper speaks about the Maintenance Guarantee Fund and problems in it’s work.
