Brīvas preču aprites ierobežojumi

Abstract

Darba “Preču brīvas aprites ierobežojumi” mērķis ir izpētīt tiesu praksi un valsts regulējumu par ierobežojošiem pasākumiem, pamatojoties uz valsts drošības apsvērumiem. Autore darbā pēta “valsts drošības” jēdzienu, Stratēģiskās nozīmes preču aprites likumu, nacionālo stratēģiskas nozīmes preču sarakstu un tā atbilstību Eiropas Savienības normām. Ir konstatēta Latvijas regulējuma neatbilstība Eiropas Savienības normām, ierobežojošo pasākumu nesamērīgums, kā arī Eiropas Savienības regulējuma pārkāpuma. Ir izpētīta arī tiesu prakse, citu valstu prakse, atbalstot vai neatbalstot “spiegošanas ierīču” lietošanas ierobežojumus, un iekļauti vairāku autoru atzinumi. Autore piedāvā atcelt lietošanas ierobežojumus, jo mērķis var tikt sasniegts citiem, mazāk ierobežojošiem līdzekļiem, ar regulējumu, kurš Latvijā jau ir pieņemts.

Work "Abridgement or free movement of goods" aims to investigate the case law and national legislation concerning restrictive measures based on national security considerations. The author explores the "national security" concept, Law on the circulation of goods of strategic significance, national strategic goods list and its compliance with European Union standards. It is found in Latvian regulatory non-compliance with European Union standards, the restrictive measures disproportionality, as well as the European Union's regulatory violation. It’s explored in the case law of other countries the practice of supporting or dissupporting the "spy devices" use restrictions, and includes several authors opinions. The author proposes to eliminate the restrictions of usage of the goods, as the goal can be achived by using diffirent mesures, less restrictive means of regulation, which already has been approved in Latvia.
