Latvijas Valsts prezidenta vieta varas dalīšanas sistēmā.

Abstract

Darba mērķis ir pierādīt, ka Latvijas Republikas Satversmē Valsts prezidentam piešķirtās pilnvaras ir pārāk vājas, tādēļ tās ir nepieciešams pastiprināt. Latvija ir izteikta parlamentāra republika un tajā parlamenta pozīcijas rokās atrodas vara parlamentā, Ministru kabinetā un teorētiski arī Valsts prezidenta institūcijā, jo prezidentu ievēl Saeima, tādējādi netiek pietiekami labi ievērots varas dalīšanas princips. Latvijā Valsts prezidenta institūcijas mērķis ir būt izlīdzinošam spēkam starp varas atzariem, kā arī reprezentēt valsti un vienot tautu. Taču to ir labāk iespējams panākt, ja Valsts prezidents ir neatkarīgāks nekā šobrīd, ja prezidentu ievēl tauta un atsevišķas viņa funkcijas ir spēcīgākas. Darbā autors sniedz konkrētus priekšlikumus par nepieciešamiem Satversmes grozījumiem, lai uzlabotu varas dalīšanas ievērošanu Latvijā.

The main goal of the paper is to prove, that powers of the president of Latvia provided by the constitution are too weak, so they must be strenghtened. Latvia is a parliamentary republic and the majority of parliament holds the control of parliament, government and the president, because president is elected by the parliament, therefore the principle of separation of powers is not implemented enough. The main purpose of the president of Latvia is to provide the balance between other branches of power, to represent the state and to unite the nation. However the goal could be reached better if the president was more independent than now, if he was elected directly by the nation and some of his powers were stronger. The author gives concrete suggestions about the necessary amendments of constitution, so the separation of powers would be better realized in Latvia.
