Maģistra darba „īpašuma atvasinātā iegūšana” mērķis ir izpētīt un izanalizēt īpašuma atvasinātās iegūšanas būtību un veidus civiltiesību normās, identificējot ar to saistīto problemātiku, un izstrādāt priekšlikumus esošo tiesību normu pilnveidei. Darba ietvaros izvirzītā mērķa sasniegšanai, autore veic esošo normatīvo aktu, tiesu nolēmumu, lietu tiesību ekspertu, kā arī ārvalstu normatīvo dokumentu salīdzinošo analīzi un vērtējumu.
No jauna iegūtās lietas parasti nepatērē to sākotnējie ieguvēji, bet nereti tās nodod tālāk, tad ir atzīstams, ka atvasināto īpašuma tiesību pielietošanas lauks ir ievērojami plašs, turklāt šajos gadījumos arī veidojas virkne juridisku problēmu un strīdu, kuru risināšana ir niansēts un aktuāls jautājums, kas mudinājis autori pievērsties īpašuma atvasinātās iegūšanas juridisko aspektu izpētei.
Veicot dažādu valstu civiltiesību normu, to piemērošanas prakses un tiesību ekspertu viedokļu analīzi un izvērtējumu, darba kopsavilkumā tiek sniegti priekšli The objectives of the master thesis „Derivative Acquisition of Property” is to examine and analyze the nature of the derivative acquisition of property and it types of civil law rules, identifying related problems, and draw up proposals for improving the existing provisions of the law. To achieve objectives, the author does comparative analysis and assessment of existing laws and regulations, judicial decisions, legislative documents of the case law experts and foreign legislative documents.
Newly acquired things usually are not consumed by the initial beneficiaries, but they often have been passed on. It is recognized that the field of the rights of derived property is significantly wide; in addition, in these cases is a series of legal problems and disputes, which solving is detailed and actual topic. That encouraged the author to concentrate on the legal aspects of derivative acquisition of property.
Analyzing and evaluating the various national civil laws and the applica
