Bērna interešu ievērošana Hāgas 1980. gada 25. oktobra konvencijas par starptautiskās bērnu nolaupīšanas civiltiesiskajiem aspektiem mērķu izpildē

Darba pirmajā nodaļā tiek analizētas, kuras bērnu tiesības un intereses, tiek ievērotas Hāgas Konvencijas galveno mērķu – novērst bērnu nolaupīšanu un nodrošināt ātru bērna atgriešanu viņa pastāvīgajā dzīvesvietā – izpildē.
Darba otrajā nodaļā analizēta bērnu interešu ievērošana preventīvajos pasākumos. Aplūkots Hāgas Konvecijas dalībvalstu regulējums, kas paredz preventīvos pasākumus un vērtēts, kuras bērnu intereses preventīvajos pasākumos tiek uzskatītas par prioritārām. Tā kā preventīvie pasākumi pamatā balstās uz aizliegumu izbraukt no valsts, sīkāk tiek analizēta valstu regulējums attiecībā uz pasu izsniegšanu, robežkontroli, kā arī tiesu nolēmumu nozīme preventīvajos pasākumos.
Darba trešajā nodaļā tiek analizēta bērnu interešu ievērošana bērna atgriešanas procesā. Vērtēta Hāgas Konvencijas un Briseles IIbis regula, kas nosaka bērnu atgriešanu viņa pastāvīgās dzīvesvietas valstī starptautiskā līmenī. Kā arī vērtēti tādi Latvijas normatīvie akti kā Civilprocesa likums, likums par Bāriņtiesām, kas nosaka bērna atgriešanas procesu nacionālajā līmenī. In the first chapter observation of children's rights and interests on performance of main objectives of the Hague Convention - to prevent child abduction and to ensure the prompt return of the child to the State of his/her habitual residence, are analyzed.
In the second chapter the observation of the children’s interests in preventive measures is analyzed. The regulations of preventive measures of the member states of the Hague Cinvention are examined to estimate which children's interest s in preventive measures are considered as a priority. As preventive measures are essentially based on the prohibition to leave the country, the national regulation for the issuance of passports, border control, as well as the role of judgments of national courts on preventive measures are analyzed in detail.
In the third chapter x the observation of children's interests in the child's return process is analyzed. The Hague Convention and the Brussels IIbis regulation governing the return of a child to the State of his habitual residence at the international level are analyzed. As well as Code of civil proceeding of Latvia, the Law on Orphan’s court , which provides the child return process at the national level, are analyzed.
