Izlīgums kriminālprocesā

Abstract

Maģistra darba tēma ir „Izlīgums kriminālprocesā”. Maģistra darba mērķis ir izpētīt izlīguma institūta efektivitāti Latvijā un identificēt izlīguma institūta realizācijas problēmas, kā arī to iespējamos risinājumus. Veicot pētījumu maģistra darba ietvaros, autore konstatē, ka īstenojot izlīgumu praksē ne vienmēr tiek sasniegts Kriminālprocesa likuma mērķis un ka starp izlīguma tiesisko regulējumu Latvijā un citās valstīs pastāv dažas būtiskas atšķirības. Būtiskākās problēmas ir saskatāmas gan izlīguma institūta piemērošanas jautājumos, gan pašā izlīguma institūta normatīvajā regulējumā. Attiecībā uz piemērošanas jautājumiem, problemātika ir saskatāma nepareizā tiesību normu interpretācijā, kas noved pie nepareiza krimināllietas iznākuma. Attiecībā uz trūkumiem normatīvajā regulējumā, pamatproblēmas ir saskatāmas attiecībā uz izlīgumā iesaistītā subjekta – cietušā pārstāvja statusu un cietušā aizvietotāja statusu, ja cietušais noziedzīgā nodarījuma rezultātā ir gājis bojā, pierādīšanas problēmām izlīguma gadījumā, kā arī izlīguma nosacījumu izpildes kontroli jau pēc izlīguma noslēgšanas. Analizējot izlīguma institūta problemātiku Latvijā, autore secina, ka Kriminālprocesa likumā ir nepieciešams ietvert izlīguma definīciju, kā arī veikt virkni grozījumu jau pašlaik esošajā regulējumā, piemēram, jāietver nosacījums, ka kriminālprocess, pamatojoties uz izlīgumu būtu izbeidzams tikai tad, kad ir izpildīti visi izlīguma nosacījumi, kriminālprocesu pamatojoties uz izlīgumu nevar izbeigt, ja noziedzīga nodarījuma rezultātā ir iestājusies personas nāve un citi grozījumi.

The theme of this Master’s Paper is «Mediation in criminal process». The purpose of following Master’s Paper is to examine the efficiency of mediation in Latvia and to specify the problems of its implementation, as also their possible solutions. As a part of present Master’s Paper study, the author has established that not always using the mediation in practice the purpose of Criminal process Law is obtained, as well there are some considerable distinctions between legal regulation of mediation in Latvia and in other countries. The most considerable problems appear both in the implementation of mediation, and the legal regulation of mediation. In relation to an implementation, the main problem presents in a wrong interpretation of rules of law that can result in a wrong outcome of criminal case. In reference to the apparent gaps of standard regulation, the main concerns are about the person involved in mediation, the status of the representative of the victim and the status of the replace of the victim, if the victim dies as a result of a crime, and the problem of evidences in the case of mediation, as well as the control on fulfilment of the conditions after the mediation is agreed. Reviewing the range of problems of mediation in Latvia, the author comes to opinion that it is necessary to include the definition of mediation in the Criminal process Law, along with a number of changes are to be done in existing regulation, for example, to include a condition that criminal process, if being based on mediation, would be dismissed only if all conditions of mediation are fulfilled, and criminal process isn't subject to dismissal if as a result of a crime there was a death of the person and other changes.
